본 논문은 롤즈(John Rawls)의 재산소유 민주주의(property-owning democracy, 이하 POD)에 부합하는 기업(corporation, firm, enterprise etc.)의 형태와 특징이 무엇인지를 규명하고자 한다. 본 논문이 롤즈 POD의 다양한 논의들 가운데 기업에 집중하는 이유는, 기업이 정의론의 핵심 가치 중 하나인 상호성(reciprocity)을 구현하는 사회 협력(social cooperation) 경험 증진에 효과적으로 기여하는 결사체(association)이면서도, 동시에 악용되거나 오용되면 이를 파괴할 수 있는 결사체이기 때문이다. 이를 위해 본 논문은 먼저 롤즈 논의들에 산재된 POD 관련 논의들을 통해 정의론에 부합하는 POD의 특징과 가치를 분석하고(2장), 이에 부합하는 기업의 형태와 특징을 제시하고자 한다(3장). 롤즈의 공정으로서의 정의(justice as fairness)는 개인적 측면에서 사회 구성원들의 자존감(self-respect)과 자유를 향유하게 하고 사회적 측면에서 상호성에 입각한 사회 협력을 지속적으로 할 수 있게 하는 사회 체제를 지향한다. 이러한 사회체제인 POD는 다양한 기업 형태들이 서로 경쟁하면서, 정도의 차이는 있겠지만 사회구성원들이 자존감과 자유를 향유하게 하고 상호성에 따라 사회 협력 과정을 지속하게 할 것이다. 또한 POD는 이 과정에서 금융 정책이나 재정 정책 등의 다양한 정책들을 통해 POD의 추구 가치를 더욱 잘 구현하는 기업 형태들, 예를 들어 ESG 경영을 추구하는 기업 형태를 지원할 것이다. 신자유주의 자본주의로 인해 사회적·경제적 불평등이 극심해지고 있는 현대 사회에서 롤즈 정의론에 부합하는 기업 형태를 제시하는 것은 사회 협력 경험 증진을 통해 롤즈 정의론이 구현되는 사회를 실현하려는 시도에 시사점을 줄 것이다.
The purpose of this paper is to explore which forms of corporation are consistent with John Rawls’s property-owning democracy (hereafter POD). The reason why this paper focuses on corporations among the various discussions of Rawls’s POD is that corporations are associations that can effectively contribute to promoting experiences of social cooperation that embody reciprocity, one of the core values of POD, but they are also associations that can be exploited or misused to destroy it. To this end, this paper first analyzes the features and values of POD that are consistent with Rawls’s theory of justice and proposes forms and characteristics of corporations that are relevant to POD. Rawls’s justice as fairness aims for a social system that enables members of society to enjoy self-respect and freedom at the individual level and to continue social cooperation based on reciprocity at the social level. Such a social system, POD, will allow various corporate forms to compete with each other, and various policies, such as financial policies and tax policies, will be proposed to promote corporate forms that better embody the values of POD, such as corporate forms with ESG management. In a modern society where social and economic inequalities are becoming more extreme due to neoliberal capitalism, presenting corporate forms that are consistent with Rawls’s POD will have implications for attempts to realize a society in which Rawls’s theory of justice is realized through the promotion of social cooperation experiences.
