본 연구는 WTO 체제하에서의 중국 보조금 정책의 개선방안을 도출하기 위한 연구이다. 이를 위해 기존 문헌 연구와 사례 분석을 진행하였다. 첫째, 기존 문헌 연구는 기존 문헌 연구는 지금까지 WTO 보조금 분쟁사례와 판정문에 대한 국제기구 공식출판물을 비롯하여, 수출보조금, 상계관세, 보호무역 정책, 보조금 정책 효과에 관한 선행연구를 분석하였다. 둘째, 사례 분석은 중국이 상계관세판정을 어떻게 대비하는지에 대해 시사점을 주는 WTO 보조금 분쟁사례를 선정하여, WTO 보조금 분쟁사례에서 판정된 결과를 바탕으로 미국과 EU의 조사한 중국 보조금 제도를 WTO 보조금협정과 불일치한 부분을 규명하였다. 그리고 상계관세판정을 제소받고 있는 중국 보조금 정책을 선정하여, WTO 보조금 분쟁사례에서 판정된 결과를 기반으로 중국 보조금 정책은 WTO 보조금협정과 불일치한 부분을 분석하였으며, 앞으로 상계관세 분쟁을 줄이기 위해 정책적 개선방안을 제시하였다.중국이 상계관세판정을 어떻게 대비하는지에 대해 시사점을 주는 WTO 보조금 분쟁사례를 바탕으로 주요 판정 결과를 분석하였다. 이를 토대로 미국과 EU가 조사한 중국 보조금 제도를 재정적 기여, 특정성, 금지보조금을 중심으로 분석하였다. 미국이 중국의 다양한 보조금 정책에 대해서 상계관세 조사한 판정문을 중심으로 WTO 보조금 분쟁사례와 비교하였다. 이를 통하여 미국의 상계관세 조사를 받은 중국 보조금제도가 WTO 보조금협정에 규정된 재정적 기여, 특정성, 금지보조금에 해당하여 WTO 보조금협정의 주요 원칙과 일치하지 않는 결과가 나타났다. EU 집행위원회는 중국의 다양한 보조금 정책에 대해서 상계관세 조사한 판정문을 중심으로 WTO 보조금협정에 합치하는지를 평가하였다. 그 결과, EU의 중국제품에 대한 상계관세 조사를 받은 중국 보조금제도가 WTO 보조금협정에 규정된 재정적 기여, 특정성, 금지보조금에 해당하여 WTO 보조금협정의 주요 원칙과 일치하지 않는 것으로 나타났다. 보조금 분쟁사례에서 제소받고 있는 중국의 보조금 정책 대표적인 10 가지 보조금 정책에서 WTO 보조금협정과 불일치한 부분은 예를 들면, 태양광 발전 보조금 정책 중 전력망 기업이 전기료 지급을 통해 전력과 관련된 권리를 취득하는 행위가 재정적 기여인 “상품구매”에 해당하며, 신재생 에너지 자동차 보조금 정책에 따른 보조금 지급 대상이 신재생 에너지 자동차 생산기업만 제공된다고 규정하고 있으므로, 신재생 에너지 자동차 보조금은 WTO 보조금협정에 규정된 특정성이 성립한다. 또는 과학기술보조금 정책 중의 기업은 과학 기술 보조금을 통해서 외국상품과 경쟁에서 유리한 위치를 차지하기 때문에 국내상품의 사용을 조건으로 하는 보조금에 해당하여 금지보조금으로 간주한다. 이를 바탕으로 중국 보조금 정책의 산업별로 개선방안을 제기할뿐더러 중국 보조금 정책의 전반적인 개선방안도 제기한다. 금지보조금의 제거, 상계가능보조금의 신중히 사용, 상계관세 경보 메커니즘의 설립, 기업은 적극적인 응소, WTO 분쟁해결기구의 충분한 이용 등은 이 논문이 제기할 수 있는 중국 보조금 정책의 개선방안이다.
This study is to derive measures to improve China's subsidy policy under the WTO system. To this end, existing literature studies and case analysis were conducted. First, existing literature studies have analyzed previous studies on export subsidies, countervailing duties, protectionism, and subsidy policy effects, including official publications by international organizations on WTO subsidy disputes and judgments. Second, the case analysis selected a WTO subsidy dispute case that had implications for how China prepared for countervailing duty, and based on the results of the WTO subsidy dispute case, the US and EU investigated the Chinese subsidy system was inconsistent with the WTO subsidy agreement. In addition, the Chinese subsidy policy, which is being sued for countervailing duty, was analyzed for inconsistencies with the WTO subsidy agreement based on the results of the WTO subsidy dispute case, and policy improvement measures were proposed to reduce countervailing duty disputes in the future.The results of major decisions were analyzed based on the WTO subsidy dispute case, which has implications for how China prepares for countervailing tariff decisions. Based on this, the Chinese subsidy system surveyed by the United States and the EU was analyzed focusing on financial contribution, specificity, and prohibited subsidies. It was compared with the case of the WTO subsidy dispute, focusing on the decision of the U.S. to investigate countervailing duties on various subsidy policies in China. Through this, the Chinese subsidy system, which was investigated by the U.S. countervailing duties, corresponds to the financial contributions, specificities, and prohibited subsidies stipulated in the WTO subsidy agreement, which is inconsistent with the main principles of the WTO subsidy agreement. The EU Commission evaluated whether it conforms to the WTO subsidy agreement, focusing on the decision of the countervailing duty investigation on various subsidy policies in China. As a result, it was found that the Chinese subsidy system, which was subject to countervailing duty investigation on Chinese products by the EU, was inconsistent with the main principles of the WTO subsidy agreement, corresponding to the financial contributions, specificities, and prohibited subsidies stipulated in the WTO subsidy agreement.China's subsidy policy, which is being sued in the case of a subsidy dispute, contradicts the WTO subsidy agreement, for example, the act of a power grid company acquiring power-related rights through electricity payment constitutes a financial contribution, and only renewable energy car subsidies are provided. Alternatively, an entity in the science and technology subsidy policy is considered a prohibited subsidy because it occupies an advantageous position in competition with foreign products through science and technology subsidies. Based on this, it not only raises measures to improve China's subsidy policy by industry, but also proposes overall improvement measures of China's subsidy policy. Removal of prohibited subsidies, careful use of offsettable subsidies, establishment of countervailing tariff warning mechanisms, active response by companies, and sufficient use of the WTO dispute settlement organization are ways to improve China's subsidy policy that this paper can raise.
