이 논문은 최근 한국사회에서 일어난 불교와 보수 개신교 진영 사이의 갈등 배경과 그 의미를 종교차별금지, 종교자유, 정교분리로 대변되는 헌법적 규범에 초점을 두면서 분석하였다. 분석 사례는 공직자의 종교차별, 템플스테이, 종교평화법 제정을 둘러싼 세논쟁이다. 첫 번째는 이명박 전 서울시장의 ``서울시 봉헌``과 같은 개신교인 공직자들의 행위가 정당한가를 둘러싼 논쟁이다. 불교측은 개신교인 공직자들의 행위들을 성시화운동의 산물로 보면서 정교분리 위반으로 주장한 반면, 보수 개신교 진영은 공직자가 누릴 수 있는 종교자유권의 행사라고 반박하였다. 이 논쟁은 공인이 지켜야 할 정교분리의 의무와 사적 개인이 누려야 할 종교자유의 권리 사이의 충돌로서 여기에는 공과 사의 이분법이 작동하고 있다. 두 번째는 템플스테이 사업에 대한 정부의 재정지원의 정당성을 둘러싼 논쟁이다. 보수 개신교 진영은 템플스테이에 대한 정부의 재정지원이 정교분리 원칙에 위배된다고 주장한 반면, 불교측은 반대의 입장을 취했다. 즉 보수 개신교 진영은 템플스테이가 포교활동에 속하므로 정부의 재정지원이 정교분리 위배라고 주장한 반면, 불교측은 템플스테이가 전통문화의 범주에 속하므로 정교분리에 위배되지 않는다고 반박하였다. 이 논쟁의 배후에는 템플스테이의 성격을 둘러싸고 종교와 문화의 이분법이 작동하고 있음을 알 수 있다. 세 번째는 ``땅밟기`` 사태로 촉발된 종교평화법 제정을 둘러싼 논쟁이다. 불교측은 보수 개신교 진영의 공세적 선교활동이 종교평화를 저해하므로 선교활동을 어느 정도 제한하는 종교평화법 제정이 필요하다고 주장한 반면, 보수 개신교 진영은 선교활동을 제한하는 법은 종교자유에 대한 심각한 침해가 될 수 있으므로 법 제정에 강하게 반대하였다. 이처럼 종교차별금지, 종교자유, 정교분리와 같은 헌법상의 규범들은 보편성과 중립성을 지닌 자명한 개념처럼 보이지만 구체적 현실에서는 다양한 주체의 욕망에 의해 끊임없이 소환되면서 그 내용이 채워지는 ``텅빈 기호``인 동시에 주체들의 협상에 의해 그 내용이 변화되는 매우 불안정하고 논쟁적인 개념이다.
This paper aims at the exploration of background and meaning of the religious conflicts between Buddhism and protestant conservatives in recent Korea, focusing on constitutional norms such as "no discrimination based on religion," "religious freedom," "separation of religion and state." Three kinds of conflict between Buddhism and conservative Protestantism occurred recently. The first was controversy surrounding protestant public servants` religious speeches and behaviours. Buddhists claimed that their religious practices violated the principle of separation of religion and state, while protestant conservatives responded that their behaviours belong to the right to religious freedom. In this controversy the principle of separation of religion and state which should be observed by public servants collided with the private person`s right to religious freedom. The second was conflict about the legitimacy of government`s support to temple stay program. While protestant conservatives considered state`s support to temple stay program as violation of the principle of church-state separation, Buddhists responded that government`s support to that program is not at odd with the principle of separation of religion and state. In protestant conservatives` view temple stay program was religious one, but, in Buddhists` argument that program was cultural one. The third was controversy about the necessity of enactment of Religious Peace Law. Buddhists argued lawmaking is necessary for the inter-religious peace, emphasizing that protestants` aggressive proselytism brings about religious conflicts. Conversely, protestant conservatives were opposed to the enactment of that law, claiming that lawmaking could threat the right to religious liberty, especially, evangelization. These conflicts show that constitutional norms such as no discrimination based on religion, religious freedom, and separation of religion and politics are not stable but unstable. In other words, these norms are not universal or neutral concepts but essentially contested concepts which could be used by subjects of desire.
