투자 협정과 지역적 인권협약의 확산은 국가들을 새로운 차원의 법적 책임에 노출시켰고, 대항조치와 같이 국제법상 위법성조각 사유에 대한 전통적인 해석을 복잡화했다. ILC의 국가책임 초안은 본래 국가간 충돌을 염두에 두고 성안되었던 것이기에, 투자자-국가간 분쟁이나 지역적 인권재판소를 통한 제소 등 사인이 국가를 대상으로 하는 청구에 대처하기 적합한 구조로 되어 있지 않다. 대표적으로 ILC 초안상 규정된 대항조치의 요건들을 모두 충족하더라도 국가간 분쟁의 제3자에 대해서도 위법성이 조각되는지 여부도 확실하지 않은 상황이다. 본 논문은 정당한 목적을 가지고 대항조치에 부여된 '한계'들이 변화한 국제 사회의 지형 속에서는 궁극적으로 대항조치 자체의 활용성을 반감시킨다는 사실을 조망한다. 추가적으로 특별법 우선의 원칙과 Monetary Gold 원칙이 이러한 투자자-국가간 분쟁해결절차와 지역적 인권재판소 쟁송에서 선제적으로 대항조치 항변을 배제하는지 점검한다. 이를 통해 여러 판정부와 재판부, 학계의 논의 등에서 나타나는, 개인 및 투자자 지위의 향상과 대항조치 및 국가책임의 법리가 충돌하는 지점들을 짚어내고, 그 딜레마의 해결 방향을 모색하고자 한다.
The proliferation of investment treaties and regional human rights treaties have exposed States to new forms of legal liability and complicated traditional understandings of circumstances that preclude wrongfulness in international law such as countermeasures. ILC’s work on state responsibility was written with inter-state disputes in mind and is not particularly well-equipped to deal with claims that individuals bring against States in investor-state disputes or regional human rights courts. It is unclear, for example, whether countermeasures preclude wrongfulness against third parties to the inter-state dispute, even when the traditional requirements for countermeasures are fulfilled. This paper aims to analyze how the well-intended limitations placed on countermeasures ultimately undermine their effectiveness in investor-state disputes and regional human rights courts. Moreover, this paper will examine whether lex specialis and the Monetary Gold principle precludes States from invoking countermeasures defense against individuals in such legal regimes. It will become apparent how our legal principles on the law of countermeasures and international state responsibility must change in order to adapt to the changing views on individual rights presented by various tribunals, courts, and commentators.
