조희연 서울특별시 교육감이 「공직선거법」 제250조 제2항을 반하였다는 이유로 교육감 직을 내놓을 뻔 했던 사건에서 표현의 자유의 한계 설정이 핵심쟁점이 되었다. 따라서 이를 중심으로 공직선거과정에서의 상대후보자에 대한 공직적격검증에서의 의혹제기가 어느 범위까지 표현의 자유 영역에 포섭될 수 있을지가 문제된다. 조희연 교육감에 대한 제1심 판결과 제2심 판결을 토대로 정치적 표현의 자유가 구현된 정도를 논증한다. 2014. 6. 14. 실시된 서울특별시 교육감 선거에 출마한 후보자였던 조희연은 같은 선거에 후보자로 출마한 고승덕에 대해 `미 영주권 문제를 즉각 해명하라`는 등의 표현을 하여 의혹을 제기하였고 고승덕은 미국 영주권을 보유한 사실이 없었다. 동 사건에서 공직선거법으로 대표되는 정치적 표현의 자유에 대한 제한 입법을 살펴보고 상대후보에 대한 의혹제기가 표현의 자유 한계 범위내의 것이라 판단한 재판부의 판단에 대해 소고한다. 1차 공표에 대하여, `고승덕 후보는 미 영주권 문제를 즉각 해명하라`라는 제목에서도 알 수 있듯이`해명을 촉구`하는 것이지, 영주권 보유 사실을 암시하였다고 볼 수 없다. 또한 개인정보의 보호 측면에서 제3자인 피고인은 물론이고 경찰까지도 확인이 불가능한 영주권 보유 여부를 내용증명으로 확인할 것을 요청하는 2차 공표는 확실한 증거 제시를 촉구하는 측면의 의견 표명으로 보아야 한다. 선거 과정은 의혹 확인을 위한 시간적 한계를 가지고 있다는 점을 고려하면 후에 허위로 판명 난 경우라 하더라도 ① 전문가로부터 의혹을 확보한 경우, ② 공공기관의 자료 등을 바탕으로 한 경우, ③ 언론의 보도를 신뢰한 경우, ④ 다수의 증언이 확보된 경우, ⑤ 학술적 자료에 근거한 경우 등에는 미필적 고의를 부정하거나, 설령 인정하더라도 진실이라고 믿을 만한 상당한 이유가 있는 경우로 보아야 할 것이다. 결국, 조희연 교육감 사건은 정치적 표현의 자유의 일환으로서 필요하고 중요한 공직 담당 적격 검증의 일종으로 보아야 한다. 전문기자의 글과 전언을 신뢰하지 못한다면, 또한 본인이 아니면 확인이 불가한 사실에 대해서까지 의혹 제기가 허용되지 않는다면 공직 후보자의 검증은 사실상 불가능해질 것이고, 대의정치를 통한 국민주권의 실현을 어렵게 만드는 일이 될 것이기 때문이다.
Remarks made in eligibility verification during electoral processes frequently give rise to controversies in balancing freedom of expression and a fair election. So was the case of Cho Hee Yeon, Superintendent of Seoul Metropolitan of Education, who came within a whisker of resignation for prohibiting clause (1) of Article 250 of 「Public Official Election Act」. The point of dispute stood on defining limits on the freedom of expression. This article examines the extent to which freedom of political expression has been realized in the case of Cho throughout casting a doubt against opposition candidate in verifying opposing party`s eligibility as a public official, especially in reference to the verdicts of the first and second trials. Cho Hee Yeon who ran for Seoul Education Superintendents Election held on Jun 14, 2014 cast a doubt on Koh Seung-duk, the opposing candidate, by arguing about “Koh`s necessity to immediately explain his US permanent residency problem”. However, in fact, the candidate Koh did not hold US permanent residency. This article demonstrates a legislation to limit the freedom of political expression represented by Public Official Election Act from the same case and traces back on the judgement from judiciary which viewed the Cho`s cast of doubt on the opponent as an opinion lying within the limit of freedom. With regards to his first announcement, as it can be known from the title “Koh to immediately explain his US permanent residency problem”, it urges Koh to explain the problem, but does not imply his holding the residency. Additionally, the second announcement, which requests a confirmation by certification of contents on his residency status which cannot be inquired not only by criminal defendant who was third party but even by police for the protection of personal information, ought to be viewed as an expression of opinion for demanding presentation of a reliable evidence. It is widely acknowledged that more period is required on confirmation of the doubts upon the candidates. Accordingly, despite its proven falseness, the following cases shall be accounted as good grounds to deny willful negligence or to believe such doubts: ① securement from experts, ② securement based on materials from public institution, ③ trusts on press reports, ④ securement of testimonies of many, ⑤ securement based on academic literature. Hence, the case of Cho shall be regarded as one example of necessary and essential eligibility verification process in the public official election, under close connection with the freedom of political expression. If articles and statements of professional journalists are not trusted, and if arousal of doubts on points that can only be verified by the said party oneself is not allowed, it is inevitable for de facto verification of public official candidates to become impossible, eventually leading to massive impediments in realizing popular sovereignty through a representative government.
