어떤 특허발명의 실시를 허락하는 실시계약이 체결된 이후 그 계약의 실시권자가 실시허락자를 상대로 해당 특허의 무효심판을 청구하는 경우, 그 실시권자의 청구인 적격을 인정해야 하는지에 대해 이견이 존재하였다. 미국에서는 한때 ‘실시권자 금반언(licensee estoppel)’의 원칙이 적용되어 실시권자의 이해관계를 인정하지 않았으나 1969년 Lear 판결이 그 실시권자 금반언 원칙을 폐기하고 실시권자가 실시료를 지불하는 불이익에서 벗어나고 특허발명에 대하여 무효를 주장할 수 있게 되었다. 2004년 Gen-Probe 판결에서 실시료를 계속 지불하는 실시권자가 ‘사건·분쟁 요건’이라는 미국 헌법이 규정하는 소송을 제기할 수 있는 전제조건을 만족하지 않아 (실시료를 계속 지불하는) 실시권자의 특허무효심판의 청구인 적격을 인정하지 않았다. 그러다 2007년 미국 연방대법원은 Medlmmune 판결에서 Gen-Probe 원칙을 다시 폐기하고 실시료를 지불하는 (통상)실시권자도 대상 특허에 대하여 무효를 주장할 수 있는 것으로 법리를 정리하였다. 한국에서는 2019년 대법원 2017후2819 전원합의체 판결에서 (통상)실시권자의 이해관계를 인정하는 것으로 법리를 정리하였다. 그 판결로 ‘통상’실시권자의 청구인 적격에 대한 법리가 어느 정도 정리되었다고 생각된다. ① 한국의 2019년 대법원 2017후2819 전원합의체 판결에서 실시권자의 청구인 적격을 인정하였으나 해당 판결에서의 ‘실시권자’에는 전용실시권자도 포함되는지? 본 논문은 그와 관련된 추가적인 쟁점, 즉 전용실시권자의 무효심판 청구인 적격을 탐구하고자 한다. 또 통상실시권에 관하여 일본 학설에서는 통상실시권을 “독점적 통상실시권”과 “비독점적 통상실시권”으로 나누고 있다. 또 실무에서 법문에 정의되어 있지 않은 ‘독점적 통상실시권’이라는 용어를 사용하고 있고 이를 1인에게만 부여하는 통상실시권으로 해석하고 있다. 현행 한국의 일부 학자도 일본의 ‘독점적 통상실시권’의 용어와 그 해석을 차용하여 사용한 바 있다. 나아가, ‘독점적 통상실시권자’의 침해소송 원고적격의 인정 여부에 대하여 다수 논의가 존재하여 왔다. ② 독점적 통상실권은 개념상 통상실시권을 1인에게만 부여하고 타인에게 실시권을 더 이상 부여하지 않겠다는 특약에 불과하다. 통상실시권이 ‘독점적’이므로 전용실시권과 유사한 권리를 갖게 되는지? 또 전용실시권자에게 특허권침해소송의 원고 적격을 인정하듯이 독점적 통상실시권자에게도 인정해야 하는지? 본 논문은 ‘독점적 통상실시권’의 용어 및 개념을 재정립하고 이에 따른 침해소송 원고적격을 연구하고자 한다. 본 논문에서는 위의 ⓵ 및 ⓶ 의문을 해결하기 위하여 주요국에서의 특허권자, 통상실시권자, 전용실시권자 나아가 독점적 통상실시권자의 법적 지위를 연구하고 통상, 전용, 독점적 통상실시권자를 포함한 실시권자의 무효심판 청구인 적격 법리 또는 특허권 침해소송 원고적격 법리에 관하여 연구한다.
After a license agreement permitting the operation of a patented invention was concluded, if the licensee of the contract filed a request for invalidation of the patent against the licensee, there was disagreement as to whether the licensee should be recognized as a claimant. In the United States, the principle of ‘licensee estoppel’ was once applied and the licensee’s interest was not recognized, but in 2007, the Federal Supreme Court settled the legal principle by recognizing the licensee’s suitability as a plaintiff in the Medlmmune decision. In Korea, the Supreme Court's case no. 2017 Hu 2819 ruling in 2019 settled the legal principles by acknowledging the interest of the licensee. It is believed that the two rulings have settled the legal principles regarding the standing status of non-exclusive licensees as claimants to some extent. ① In Korea, the Supreme Court's case no. 2017 Hu 2819 ruling in 2019 unanimous decision recognized the licensee’s standing as a claimant, but does ‘licensee’ in that ruling include exclusive licensees? This paper seeks to explore an additional issue related to this - the standing of exclusive licensee to claim invalidity. Also, regarding non-exclusive license, Japanese theory divides it into “sole non-exclusive license” and “bare non-exclusive license,” which do not exist in the law. Also, in practice, the ‘sole non-exclusive license’, which is not defined in the law, is widely used, and it is difficult to interpret it as a non-exclusive license granted to only one person. The current Korean patent practice also uses the terminology and interpretation of Japan’s ‘sole non-exclusive license’. There has been a lot of discussion about whether to recognize an ‘sole non-licensee’ as a plaintiff in an infringement suit, a term that does not fit the concept. ② In concept, an sole non-exclusive license is nothing more than a special agreement to grant a non-exclusive license to only one person and not to grant any more licenses to others. Since a non-exclusive license is ‘sole’, does it have similar rights to an exclusive license? Also, just as exclusive licensees are recognized as plaintiffs in patent infringement lawsuits, should sole non-licensees be recognized as such? This paper seeks to redefine the term and concept of ‘sole non-exclusive license’ and study the eligibility of plaintiffs for infringement lawsuits accordingly. In this paper, in order to resolve questions ⓵ and ⓶, we study the legal status of patent holders, non-exclusive licensee, exclusive licensee, and even sole non-exclusive licensee in major countries, and examine the legal principles of standing for invalidation trials or patent infringement lawsuits by a licensee, including non-exclusive, and exclusive non-licensee.
