이 연구의 목적은 우리나라 장애인 범죄의 양상을 파악하고, 교도소 내의 장애인 재소자의 처우 실태를 분석함으로써, 효과적인 장애인 교정 복지 실현에 도움을 주고자 하는 것이다. 장애인 재소자는 특별한 처우를 필요로 하는 집단이다. 그러나 아직까지 우리나라는 그들을 위한 의료, 시설, 교육 프로그램이 극소수에 불과하다. 교도소 내에 장애인이 함께 수용되어 많은 불편을 겪고 있으며, 신체적 활동을 요구하는 교육, 작업, 운동 프로그램에서 소외되고 있다. 장애인 재소자 집단은 교정체제내의 핵심 대상으로서 분리되지 않으므로, 앞으로 교정실무에 여러 가지 어려움을 갖고 있는 잠재적 집단이라고 할 수 있다. 따라서 교정 정책적 차원에서 늘어나는 장애인 재소자 집단의 필요와 요구를 파악하고 이들의 안전과 건강을 보호 하는 교정 처우방안을 미리 준비하여야 할 것이다.연구 결과를 요약하면, 장애인 재소자는 교도소에 수용됨으로써 건강악화와 출소 후의 걱정, 낙후된 교정시설, 가족과의 단절, 인권 유린의 문제 등으로 어려움을 겪고 있다. 건의 사항으로 의료시설의 현대화, 교정 프로그램의 다양화, 식사의 질 향상, 생활시설의 현대화, 운동기회의 확대, 재취업 교육, 교도작업의 현실화를 요구하는 것으로 나타났다.이들을 위한 정책적 제안으로 첫째, 장애인 전문수용시설의 운용이다. 장애인을 위해 요양소나 복지관의 형태를 띠어야 할 것이며, 치료시설의 성격도 가져야 한다.둘째, 의료처우의 현실화이다. 장애인이 수형생활의 어려움 중에서 건강악화를 가장 크게 꼽고 있는 점에서 볼 때, 가장 필요한 일이라 하겠다. 현재 의료 교도소로 지정되어 있는 진주 교도소 1개소로만으로는 5만여 명의 재소자의 기초적인 의료문제를 담당하기에 부족하다.셋째, 교정 프로그램의 다양화와 생활시설의 현대화, 운동기회의 확대이다. 교정 프로그램은 있다 하더라도 대부분 일반 재소자를 위한 것이며, 장애인 재소자를 위한 특별한 교육은 없다. 취업교육은 출소 후의 재취업과 직접 관련이 되는 것이며, 출소 후의 사회 적응이 되지 않는다면 다시 범죄를 저지르고 교도소로 돌아오는 악순환이 되풀이되기 때문이다.넷째, 전문 인력의 양성과 지역 사회와의 연계이다. 우리나라는 교정을 담당하는 인력이 부족하다. 교정사회복지사와 같은 전문 인력을 양성하여 범죄인을 수용시설보다는 지역사회에 두고 재활시킨다는 '지역사회 중심 교정' 정책을 위해 전문적인 기술을 개입, 적용할 수 있어야 한다.우리나라는 아직까지 장애인 재소자에 대한 실태 파악이 되어 있지 않은 실정이다. 이들은 다른 일반 재소자들과는 다르게 대우하여야 한다. 아직 초기 단계에 있는 우리나라 교도소 내의 장애인 교정 복지를 위해 국가의 정책 수립이 시급하다.
Purpose of this study is to help establishing more effective correction welfare policies for disabled person through understanding crime pattern committed by disabled people and analyzing how they are treated in the prison. Disabled prisoners need special care comparing to the ordinary prisoners, because of their worse health condition, mental weakness and the possibility of their secondary commitment. However, there have been only a few medical services, institutions and educational programs for them in Korea. The disabled prisoners have experienced a lot of inconveniencies and they are deprived of opportunities for education, labor an sports activities. Disabled prisoners have not been in general treated as the core beneficiary of correction programs. Regarding these conditions, it seems to be difficult to apply correction programs to them, at least in the near future. So, it is essential to prepare correctional treatment programs which will secure their safety and health, considering the needs and demands of growing numbers of disabled prisoners.The results of this study tell us that disabled prisoners undergo severe difficulties such as health lapse, out of dated facilities and human rights devastation. They also worry about life after being released and extinction from family. It is found that they have demanded various correction programs, modernization of facilities, more time to exercise, reemployment education and practical prison duty.Based upon the research results obtained so far, concerning actual situations and demands from disabled prisoners, several correction welfare policies are suggested as follows :First, the special institutions should be founded to accommodate the disabled people. It is suggested that the institutions should work in the form of a sanitarium or social welfare center and should also provide medical care.Second, medical services should be improved in terms of both the quality and quantity to meet the disabled prisoners’ demands. Considering that the health lapse is reported to be the most distressing experience for large numbers of disabled persons, improvements of medical services are crucial. The sole prison which is designated as medical prison, Jinju prison, is far from enough to take care of medical problems of nearly 50,000 prisoners.Third, it is necessary to develop various correction programs, modern facilities in correction programs and the more time to exercise. Even there exist already some correction programs, most of them are not for disabled prisoners but for ordinary prisoners. Reemployment education is directly related to their successful reemployment after being released. If they could not be adapted to the society after being released, they are prone to commit crimes again and get back to prison, which make vicious circles.Finally, the emphasis is placed on the training of experts on correction welfare for disabled prisoners and their close relationship with the local communities. Korea is suffering from the shortage of human resources who are in charge of the corrections. The professional skills should be designed and applied for the policy “local community oriented correction” of which aim is the rehabilitation of the disabled criminals in local communities rather than in prison by the experts trained as community correction & welfare servant.In Korea, the actual condition of disabled prisoners has not been yet grasped. They should be treated in a different way from ordinary prisoners. However, correction welfare for the disabled in Korean prison is still at an early stage. Therefore, it is crucial that the government should establish national policies for the disabled prisoners.
