본 연구는 자동차해체재활용업에 적용되는 부가가치세 매입세액 공제특례제도의 문제점 및 개선방안을 고찰하는데 목적을 두고 있다. 이를 위해 국내 최대 규모의 자동차해체재활용업체인 A업체를 사례연구 대상으로 하여 자동차해체재활용업에 적용되고 있는 현행 조세특례제한법 제108조의 문제점들을 파악한 다음 이를 토대로 문헌연구를 통해 개선방안 도출과 함께 헌법상 조세법률주의 원칙 및 조세평등주의 원칙의 위배여부에 대한 연구를 수행하였다.본 연구의 연구결과를 요약하면 다음과 같다.첫째, 2015년 개정 자동차관리법에 따라 무등록 중간매집상에 의한 폐차 대상 자동차의 수집 또는 매집 및 알선행위가 금지되었다(자동차관리법 제57조의 2). 이에 따라 무등록 중간매집상에 의한 폐차 요청된 자동차의 위장 매입거래가 상당부분 해소되는 등 투명성이 확보되었다. 따라서 매입거래의 투명성 검증을 위해서 폐차인수증명서상 인수금액을 기재할 수 있도록 별지 제18호 서식을 변경하고 자동차등록규칙을 개정하여 말소등록을 신청할 때 구비서류로 매매대금 송금영수증을 첨부하도록 의무화하여야 한다.둘째, 조세특례제한법 제108조에 따른 같은 법 시행령 제110조 제3항의 공제대상 사업자의 범위에는 자동차해체재활용업자가 포함되어 있지 않다. 이로 인해 자동차해체재활용업은 한국산업표준분류표상 “금속류 해체 및 선별업 (E38311)”에 해당 함에도 과세당국의 자의적 해석에 따라 조세특례제한법 시행령 제110조 제3항 제5호에 따른 “재생재료의 수집 및 판매업 (G46791)”으로 간주되고 있다.현행 조세특례제한법 제108조에 따른 같은 법 시행령 제110조 제3항의 입법미비로 인해 사업자의 범위(납세의무자)에서 제외된 자동차해체재활용업자는 헌법상 조세법률주의의 이념인 과세요건을 법률로 명확하게 규정하여 국민생활의 법적 안정성과 예측가능성을 보장받지 못하고 있으므로 과세요건 법정주의에 어긋나고, 법률 규정내용이 불명확하여 과세당국의 자의적 해석이 가능하도록 맡겨져 있으므로 과세요건 명확주의에 어긋나 결국 헌법상 조세법률주의 원칙에 위배된다. 따라서 조세특례제한법 시행령 제110조 제3항의 개정을 통해 “자동차관리법에 따라 자동차해체재활용업 등록을 한 자”를 추가하는 등 부가가치세 매입세액 공제특례를 적용받을 수 있는 법률근거를 명확하게 해야 한다.셋째, 조세특례제한법 제108조 및 같은 법 시행령 제110조 제4항 제2호에 따라 같은 법 기본통칙 108-110...3에서는 중고자동차의 범위를 “자동차의 ..... 사실상 그 성능을 유지할 수 없을 때까지의 자동차 .....”라고 규정하고 있다. 여기에서 ‘사실상 그 성능을 유지할 수 없을 때까지’가 구체적으로 언제인지에 대해 조세법에서는 더 이상 규정된바 없다. 따라서 이 부분은 자동차관리법 규정에 따라 해석하게 되는 등 행정편의적인 확장해석이나 유추적용을 필요로 한다. 과세요건 등은 국민의 대표기관인 국회가 제정한 법률로써 규정하여야 하고, 그 법률의 집행에 있어서도 이를 엄격하게 해석·적용해야 한다. 행정편의적인 확장해석이나 유추적용은 허용되지 않음을 의미하므로 법률에 규정된 내용을 함부로 유추, 확장하는 내용의 해석규정을 마련하는 것은 헌법상 조세법률주의 원칙에 위배된다. 따라서 조세특례제한법 기본통칙 108-110...3의 중고자동차 범위는 “자동차의 제작 조립 또는 수입을 한 자로부터 자동차를 취득한 때부터 사실상 그 성능이 유지될 수 없도록 자동차관리법 제2조 제5호에 따라 폐차가 실행되는 때까지의 자동차를 말한다.”라고 보다 명확히 하여 시행규칙인 법률로 규정되어야 한다.넷째, 자동차해체재활용업자가 폐차 요청되어 취득한 자동차에 대해 과세당국은 1994년 4월, 1999년 6월, 2006년 5월 생성된 예규를 기초로 현재까지 재활용폐자원을 취득한 것으로 해석하고 있다. 또한 이에 근거하여 과세당국은 자동차해체재활용업자가 취득한 폐차 요청된 중고자동차에 대해 110분의 10에 해당하는 중고자동차의 매입세액공제율이 아닌 103분의 3에 해당하는 재활용폐자원의 매입세액공제율을 적용시키고 있는 등 재량적 집행을 하고 있다.그러나 2007년 제정된 자원순환법 및 2009년 개정된 자동차관리법의 시행으로 폐차 요청된 자동차를 유상 취득하는 방향으로 시장상황이 변모됨과 함께 정부정책도 중고부품의 재사용 규제로부터 재사용 활성화로 전환되는 등 경제적 실질이 변화되었다. 결국 과세당국의 행정규칙인 예규 규정이 불명확하고 그 집행 또한 자유재량에 맡겨져 있으므로 과세요건 명확주의에 어긋나 헌법상 조세법률주의 원칙에 위배된다. 따라서 과세당국은 자원순환법 제정 및 자동차관리법 개정사항이 모두 반영되고, 자동차해체재활용업의 경제적 실질이 모두 반영된 합리적인 새로운 행정규칙(예규)을 “자동차해체재활용업을 영위하는 사업자가 폐차 요청된 자동차를 인수하여 재사용 가능한 부품을 회수하고 재활용폐자원 등을 생산·판매하는 경우 조세특례제한법 제108조의 규정에 의하여 재활용폐자원 등에 대한 부가가치세 매입세액 공제특례를 적용받을 수 있다.”라고 명확히 하여 내놓아야 한다.다섯째, 세금계산서를 발급할 수 없는 자 및 부가가치세 과세사업을 영위하지 아니하는 자 등으로부터 자동차해체재활용업자는 폐차 요청된 자동차를, 자동차매매업자는 매매 요청된 자동차를 취득하고 있다. 둘 다 취득시점 현상을 기준할 때 자동차등록원부에 등록된 운행 중인 자동차를 취득하고 있다. 그러나 자동차해체재활용업자는 조세특례제한법 시행령 제110조 제3항의 사업자의 범위에서 제외됨으로써 과세당국의 자의적 해석 및 재량적 집행에 따라 재활용폐자원의 공제율인 103분의 3을 적용받고 있다. 반면 자동차매매업자는 중고자동차 공제율인 110분의 10을 적용받고 있다. 즉 조세특례제한법 제108조는 자동차매매업자에 비해 자동차해체재활용업자를 차별적으로 취급하여 기본권에 중대한 제한을 초래하고 있는 등 헌법상 조세평등주의에 위배된다.
The objective of the current study is to consider problems associated with special deductions to input tax amount for value-added tax on the automobile scrapping and recycling industry, as well as ways to address these issues. To achieve this end, a case study was conducted on Company A, the largest automobile scrapping and recycling business in Korea, to identify problems with Article 108 of the Restriction of Special Taxation Act. Based on the findings, a literature review was conducted to develop a plan for improvement and to research whether the practice violates the constitutional principles of no taxation without law and equality of tax burden.The following is a summary of the findings from the current study:First, according to the newly inserted article of the Motor Vehicle Management Act in 2015, it is prohibited to purchase or intermediate motor vehicles subject to be scraped by intermediators (Article 57-2 of the Motor Vehicle Management Act). This secured transparency as most of the fake purchases of vehicles subject to be scraped by unregistered intermediators were eliminated. Therefore to verify the transparency of the purchase agreements, the format of attachment no. 18 should be changed to include the cost of acquisition on the document that certifies the scrapping acquisition. In addition, the Motor Vehicle Regulation should be changed to make the payment receipt of the sale price with the required documents mandatory when registering for cancellation.Second, Article 110(3) of the Enforcement Decree of the Restriction of Special Taxation Act, which is based on Article 108 of the higher law, does not specify automobile scrapping and recycling businesses as being eligible for the tax deduction. Because of this, even though automobile scrapping and recycling is a “metal disassembly and assortment business” (E38311) as defined by the Korean Standard Industrial Classification, the taxation authority arbitrarily interprets the business to fall under “collection and sales of recyclable materials” (G46791), as per Paragraph Article 110(3)5 of the Enforcement Decree of the Restriction of Special Taxation Act.Due to the lack of legislation in Article 110(3) of the Enforcement Decree of the Restriction of Special Taxation Act, which is based on Article 108 of the higher law, automobile scrapping and recycling businesses are excluded from the scope of taxable entities (taxpayer). This is in violation of the principle of determining taxation conditions by law, as the legal stability and predictability are not guaranteed for such businesses through clear legal definition of taxation conditions under the constitutional principle of no taxation without law. Furthermore, the unclear legal provisions allow the taxation authority to make arbitrary interpretation, which violates the principle of clear taxation conditions, which in the end violates the constitutional principle of no taxation without law. As such, Article 110(3) of the Enforcement Decree of the Restriction of Special Taxation Act must be amended to add “those who registered as an automobile scrapping and recycling business as per the Motor Vehicle Management Act,” thereby clarifying the legal basis in which such businesses can receive special deductions to input tax amount for value-added tax.Third, in accordance with Article 108 of the Restriction of Special Taxation Act and Article 110(4)2 of the enforcement decree of the same law, the Basic General Provisions of the law 108-11...3 states that used automobile is a “vehicle... until it cannot practically maintain its performance...” Here, tax laws do not further prescribe what specifically constitutes a vehicle that “cannot practically maintain its performance.” As such, this part must be interpreted in accordance with the provisions of the Motor Vehicle Management Act, or extended interpretation or inference for administrative convenience.Taxation conditions must be regulated by the law enacted by the National Assembly that represents the people. The enforcement of such law must also be based on strict interpretation. This means that extended interpretation or inference for administrative convenience is not allowed: Arbitrarily inferring or extending contents of the law through interpretation rules is in violation of the constitutional principle of no taxation without law. Therefore, the range of used automobiles of the Basic General Provisions of the Restriction of Special Taxation Act 108-110…3 should be amended by the enforcement law to include “vehicles from the time they were obtained from those who manufactured, assembled, or imported the vehicle until the vehicle is scrapped to not be able to practically maintain its performance by Article 2, subparagraph 5.”Fourth, based on their operating procedures established in April 1994, June 1999, and May 2006, the taxation authority interprets that the acquisition of vehicles by automobile scrapping and recycling businesses under scrapping orders constitute an acquisition of recyclable waste resources. Also, based on this, the taxation authority is arbitrarily enforcing the law, by applying a deduction rate of input tax amount for recyclable waste materials (3/103), as opposed to that for used vehicles (10/110), for used vehicles for scrapping that are acquired by automobile scrapping and recycling businesses.However, the enactment of the Framework Act on Resources Circulation in 2007 and the amendment of the Motor Vehicle Management Act in 2009 required such businesses to purchase used automobile when they are to be scrapped. With this change in market situation, the government policy changed from regulating the reuse of used parts to encouraging the practice. In the end, the unclear administrative procedure of the tax authority, as well as arbitrary enforcement of them constitute a violation of principle of clear taxation conditions, which in turn violates the principle of no taxation without law. As such, the tax authority must develop new and reasonable administrative procedures that reflect the Framework Act on Resources Circulation and the amended Motor Vehicle Management Act, as well as the economic realities of the automobile scrapping and recycling business to clearly state “When business entities that engage in the automobile scrapping and recycling business acquire a vehicle that has been requested to be scrapped, and collect recyclable parts or manufacture or sell the recyclable waste resources, by the provisions of Article 108 of the Restriction of Special Taxation Act, it is possible to apply the special cases concerning deduction of input tax amount for value-added tax on recycled waste resources, etc.”Fifth, automobile scrapping and recycling businesses obtain vehicles with a request for scrapping, while automobile sales businesses obtain vehicles with a request for sales, from those who cannot issue a tax statement and those who do not lead a value-added taxable business. In both types of cases, both types of businesses are acquiring vehicles in operation as per vehicle registration papers when they acquire vehicles. However, automobile scrapping and recycling businesses are excluded from the scope of business entities as defined by Article 110(3) of the Enforcement Decree of the Restriction on Special Taxation Act, allowing the taxation authority to arbitrarily apply to them to a deduction rate of 3/100, which is reserved for businesses that handle recyclable waste resources. On the other hand, automobile sales businesses are given a deduction rate of 10/110, which is for businesses that deal with used vehicles. In sum, Article 108 of the Restriction of Special Taxation Act discriminate against automobile scrapping and recycling businesses compared to automobile sales businesses, thereby significantly restricting their basic rights and violating the constitutional principle of no taxation without law.
