21世纪国际体系的多极化走向打破了后冷战时代的"霸权稳定"局面,"帝国研究转向"应运而生,致力于重新认识法律在近代殖民宗主国的帝国扩张与殖民统治中所发挥的重要作用,研究当代全球霸权体系压制发展中国家发展权的法律机制与实例,思考中国与广大发展中国家捍卫生存权与发展权的法律实践所具有的世界历史意义.我国法学界的"帝国研究转向"从国际学术界的"国际法学的历史转向"和"思想史的国际转向"中汲取了丰富的理论资源,在与国际学术界深入交流的同时,不断推进对于法学研究的中国主体性的思考,有助于阐明"中国式现代化"在世界历史中的创造性意义,进而在法学研究和法律教育中增强主体性意识,推动法学领域"自主知识体系"的建设.
The multipolarization of the international system in the 21 st century has broken the"hegemonic stability"in the post-Cold War era,and gave rise to the"turning to empire"in legal studies.This"turning"is dedicated to re-understanding the important role played by law in the imperial expansion and colonial rule of modern colonial powers,studying the legal mechanisms and examples of the contemporary global hegemonic system that suppresses the right to development of developing countries,and rethinking the world historical significance of the legal practice of China and other developing countries to defend the rights to survival and development.The"turning to empire"has drawn rich theoretical resources from the"historiographical turning in international law"and the"international turning in intellectual history"in the international academia.Based upon in-depth exchanges with international academia,it has continued to awaken the awareness of China's subjectivity in legal research and education,and will help assess the creative significance of the Chinese path to modernization in world history as well as promote the construction of the"autonomous knowledge system"in China.
