Orientador: Yuzo Iano Tese (doutorado) - Universidade Estadual de Campinas, Faculdade de Engenharia Elétrica e de Computação Resumo: O trabalho de pesquisa desenvolvido nesta Tese decorre do fato que a regulação norteia a prestação dos serviços de forma que esta pode fomentar ou impedir que as inovações tecnológicas possam chegar às empresas e aos consumidores. Com a digitalização da televisão terrestre, entendemos que houve uma alteração no paradigma da prestação do serviço, implicando na necessidade de atualização na regulação, pois há novos objetivos para o serviço, inclusive determinados pela Política Pública para a digitalização. Confrontamos os resultados de avaliações nos canais de televisão digital, bem como a prestação do serviço com a regulação, principalmente buscando obrigações em relação a adoção das inovações tecnológicas do ISDB-T/Tb, e assim pudemos avaliar o impacto da regulação na implementação da televisão terrestre digital. Observamos que existem lacunas regulatórias que, se aplicadas, poderiam ter ampliado a qualidade do serviço prestado. De modo geral entendemos que toda a regulação dos serviços de radiodifusão, apesar de ter legislação e regulamentos vigentes desde 1962, ainda atende de forma satisfatória. Como em todo processo, sempre são necessárias algumas alterações ou correções com o foco na melhoria contínua. Especificamente em televisão terrestre digital observamos que a regulação falhou em não determinar obrigações referentes a evolução tecnológica, para atendimento aos novos objetivos definidos pela Política Pública, tais como o uso de SFN, para aperfeiçoamento do uso do espectro; a transmissão de informações relevantes usando o recurso da interatividade, visando a democratização da informação; e, ainda mais grave, na proibição da multiprogramação às emissoras comerciais que proporcionaria uma diversificação nas opções à população brasileira e que poderia ser atingida com o incentivo a indústria audiovisual regional e local. A pesquisa que realizamos nesta Tese aponta duas conclusões principais: que na digitalização da televisão terrestre a cadeia de valor foi mantida, ou seja, a transmissão foi digitalizada, mas a prestação do serviço continua no modelo analógico; e que a regulação não obrigou ou determinou a utilização do potencial técnico do ISDB-T/Tb, em grande parte pela divisão técnica entre Anatel e MCTIC Abstract: The work developed in this thesis stems from the fact that the regulation guides the provision of services so that it can foster or prevent technological innovations from reaching businesses and consumers. With the digitization of terrestrial television, we understand that there has been a change in the paradigm of the provision of the service, implying the need to update the regulation, because there are new objectives for the service, including those determined by public policy. We confront the results of evaluations in the digital television channels, as well as the provision of the service with the regulation, mainly seeking obligations in relation to the adoption of the technological innovations of ISDB-T/Tb, and thus we were able to assess the impact of regulation in the implementation of digital terrestrial television. We observe that there are regulatory lacks that, if applied, could have expanded the quality of service. In general, we understand that all the regulation of broadcasting services, despite having legislation and regulations in force since 1962, still meets satisfactorily. As in every process, some changes or fixes are always needed with the focus on continuous improvement. Specifically in digital terrestrial television we observe that the regulation failed to determine obligations concerning technological evolution, to meet the new objectives defined by public policy, such as the use of SFN, for the improvement use of the spectrum; the transmission of relevant information using the interactivity resource, aiming at the democratization of information; and even more serious, in the prohibition of multiprogramming to commercial broadcasters which would provide diversification in the options to the Brazilian population and that could be achieved with the encouragement of the regional and local audiovisual industry. The research we do in this thesis points out two main conclusions: that in the digitization of the terrestrial television the value chain was maintained, that is, the transmission was digitalized, but the rendering of the service continues as the analog model; and that the regulation has not forced or determined the use of the technical potential of ISDB-T/Tb, largely by the technical division between Anatel and MCTIC Doutorado Telecomunicações e Telemática Doutor em Engenharia Elétrica
