오늘날 국가는 더 이상 출생으로만 유지되지 않으며 국가 간 이주가 국가공동체 구성의 중요한 요소가 되었다. 한국 사회에도 외국 국적을 가지고 국가공동체의 구성원으로 생활하는 이주민이 많아진 만큼 국가작용에서 거주 외국인 관련 입법과 행정의 비중이 커졌고, 이는 필연적으로 국민을 포함한 사회 전체의 규범과 법질서에 영향을 미치게 되었다. 헌법은 국가공동체를 규율하는 규범이므로 주권자인 국민에 의해 제정된 것이다. 하지만 그렇다고 해서 국민이 아닌 외국인을 헌법적 보호에서 반드시 배제해야만 하는 것은 아니다. 국가공동체 안에서 국민과 함께 살아가고 있는 외국인도 헌법의 보호범위 내에 포함시킬 필요가 있다. 여기서 중요하게 제기되는 문제는 과연 외국인에게도 기본권에 의한 보호가 인정되는지, 인정된다면 그 보호의 정도는 국민과 비교할 때 어떠한 차이가 있는지에 관한 것이다. 다민족 및 다문화사회를 맞이한 오늘날 헌법은 이주민을 단순한 ‘외국인’이 아니라 국가공동체의 구성원으로서 함께 생활하는 ‘국민과 동등한 지위’에서 이해하여 기본권을 보장하는 방향으로 나아가는 것이 타당하다고 생각된다. 초저출산·초고령화 사회에 처한 대한민국이 지속 가능한 발전과 생존을 위해서는 이주민의 법적 지위를 다민족 및 다문화사회라는 시대적 상황 속에서 고민하여야 할 것이다. 헌법해석을 통한 새로운 검토와 그에 기초한 법제와 정책은 이주민이 가져다주는 인적·경제적·문화적 자원을 바탕으로 새로운 성장과 발전의 동력이 될 수 있으며, 사회변화와 다양성을 혁신과 통합의 자원으로 활용할 수 있을 것이다.
Today, the state is no longer maintained only by birth, and migration between countries has become an important element of the national community. As the number of immigrants living as members of the national community with foreign nationality has increased in Korean society, the proportion of legislation and administration related to foreigners staying in the national action has increased, which inevitably affects the norms and laws of society as a whole including the people. The Constitution is a norm that governs the national community, so it was enacted by the sovereign people. However, this does not necessarily mean that foreigners, not citizens, must be excluded from constitutional protection. It is necessary to include foreigners living with the people in the national community within the scope of the Constitution. The important issue raised in the relationship between the Constitution and foreigners is whether the protection of basic rights is recognized by foreigners, and if so, what is the difference in the degree of protection compared to the people? In the face of a multi-ethnic and multicultural society, it is reasonable to understand migrants not just as “foreigners” but as “equal to the people” living together as members of the national community and move toward guaranteeing fundamental rights. For sustainable development and survival in Korea, which is facing an ultra-low birth rate and super-aging population the legal status of immigrants must be considered in the context of a multi-ethnic and multicultural society. A new review through constitutional interpretation and laws and policies based on it can become a new driving force for growth based on the human, economic, and cultural resources brought by immigrants, and social change and diversity can be used as resources for innovation and integration.
