中国的金融市场正在朝着混业经营的模式改变, 随之而产生了另外一种主体-金融消费者, 金融消费者的权益保护是欧美等金融市场发达的国家中金融监管机构在市场监督过程中的重要目标, 也是国际金融立法的一个重要趋向。近年来, 由于信息不对称以及中国分业监管所造成的空白, 使得中国金融领域侵害消费者权益的情况频繁发生, 其中包括侵害消费者的知情权, 公平交易权等权益, 以及滥用消费者个人信息等情况, 因此, 金融消费者的利益蒙受了巨大损失。与此相对应, 金融消费者权益保护的相关立法却不能及时到位, 中国的《消费者权益保护法》在金融方面的针对性又十分有限。通过借鉴欧美等国家金融改革经验, 希望能为中国的金融消费者权益保护法律制度的完备提供路径, 同时通过对监管模式及立法现状的分析专门性研究相关法律问题。
Chinese financial market is moving towards mixed operation. Consequently it generates a new subject -- financial consumers. Protecting financial consumers’ rights and interests is a vital objective for financial regulators in the process of market supervision in developed countries like Europe and the United States, and is a tendency of international financial legislation. In recent years, a burgeoning number of cases of infringement of financial consumers’ rights and interests occurred, including financial consumers’ right to know, the right of fair trade and the problems in the abuse of personal information, due to the absence of supervision caused by information asymmetry and separated supervision. Therefore, financial consumers’ rights and interests suffered huge losses. At the same time, the protection of financial consumers' rights and interests is deficient in legislation and “Law for Protection of Rights and Interests of Consumers of the PRC” in the financial aspects’ coverage is very limited. On the basis of the experience of Europe, the U.S. and the South Korea in financial reform, we hope to provide a solution to complete law system of protection of Chinese financial consumers’ rights and interests. Through analyzing the current situation of supervision model and legislation, we specialized in related legal issues.
