가상화폐와 관련하여 현행 법률에서 명확한 정의 개념을 두고 있지 않음과 동시에 이와 관련한 정부의 규제 정책 방향도 명확하지 않다. 이로 인하여 가상화폐와 관련한 여러 문제, 특히 가상화폐의 법적 성격을 비롯하여 범죄행위에 대한 규제 공백이 있는 것이 실정이다. 이러한 상황에서 대법원은 가상화폐 관련 사건에 대한 판결을 내놓고 있다. 대부분의 국가들은 가상화폐를 제도권 안으로 진입시켜 규제하려고 한다. 특히 미국 증권거래위원회(SEC)는 가상화폐를 ‘증권’으로 보아 규제하려고 한다. 이에 반하여 상품선물거래위원회(CFTC)는 ‘상품’으로 보아 규제하려고 한다. 이러한 대립은 규제기관간의 주도권 논쟁으로 보일 수 있지만, 결국 제도적 틀 속에서 규제하는 것이다. 일본도 역시 자금결제법과 금융상품거래법을 통한 규제를 하고 있다. 이에 더하여 유럽연합도 법규범을 정비하여 규제하는 방향으로 가고 있다. 이에 반하여 우리나라는 여전히 논의만 하고 있을 뿐 어느 것도 해결되는 것이 없는 실정이다. 법규명의 합리적 해석을 통한 해결이 가능하지 않다면 입법을 통한 해결을 강구해야 할 시점이라 여겨진다. 이것은 가상화폐를 단순히 투기의 대상으로 제도권 편입을 거부할 이유가 이제는 다소 없어진 시점이며, 제도권 안에서 논의가 필요하다고 본다.
Regarding virtual currency, the current law does not have a clear definition concept, and at the same time, the direction of the government's regulatory policy in this regard is not clear. For this reason, there are various problems related to virtual currency, especially the legal nature of virtual currency, and there is a gap in regulations on criminal activities. In this situation, the Supreme Court is issuing a ruling on virtual currency-related cases. Most countries try to regulate cryptocurrency by entering the institutional sphere. In particular, the U.S. Securities and Exchange Commission (SEC) is trying to regulate virtual currency by viewing it as a "securities." On the other hand, the Commodity Futures Trading Commission (CFTC) tries to regulate it by considering it as a 'product'. This confrontation can be seen as a debate over leadership between regulatory agencies, but in the end, it is regulated within an institutional framework. Japan also regulates through the Fund Settlement Act and the Financial Product Transactions Act. In addition, the European Union is also moving toward reorganizing and regulating legal norms. On the other hand, Korea is still only discussing, and nothing is resolved. If it is not possible to solve the problem through rational interpretation of the legal name, it is considered time to seek a solution through legislation. This is a time when there is no reason to refuse to incorporate virtual currency into the institutional sphere simply as an object of speculation, and I think discussions are needed within the institutional sphere.
