헌법재판소의 위헌결정 법률과 국회의 후속입법에 관한 실증연구 위헌결정 법률의 후속입법 기간에 대한 전수조사 결과를 중심으로 최근 헌법재판소에서 헌법불합치결정과 함께 입법개선의 시한을 설정하였 음에도 입법부인 국회가 해당 시한 내에 후속입법을 완료하지 않음으로 인 해 사회적 혼란이 발생한 바 있고, 여전히 몇몇 위헌결정 법률의 경우에는 오랜 기간 후속입법이 지연되면서 법적 공백 상태가 계속되고 있다. 이에 본 논문은 현행 헌법에 따라 헌법재판소가 출범한 1988년부터 현재까지 위 헌으로 결정한 모든 법률에 대하여 그 후속입법 여부와 후속입법에 소요된 기간을 조사ㆍ분석하였으며, 이를 통해 위헌결정 법률의 후속입법 현황에 대한 전반적이고 객관적인 현황자료를 제시하고, 그에 대한 분석을 통해 도 출할 수 있는 문제점과 개선방안에 대해 논의하였다. 1988년부터 2023년 5월 31일까지 위헌으로 결정된 총 805건의 법률에 대 한 분석 결과에 따르면 국회는 단순위헌결정, 헌법불합치결정 등 모든 유형 의 위헌결정 법률에 대하여 후속입법을 진행해 오고 있으나, 후속입법에 3 년 이상의 기간이 소요된 비율이 12%를 넘고, 입법개선 시한이 있는 헌법불 합치결정 법률의 시한준수율이 65.2%에 그치는 등 전반적으로 후속입법이 지연되고 있는 문제가 있었다. 또한, 제13대 국회부터 현 제21대 국회에 이 르기까지 역대 국회의 후속입법 기간을 분석한 결과에서는 대의 변화에 따 른 특별한 차이점이 나타나지 않았다는 점에서 2016년 12월 신속한 후속입 법 촉진을 위해 신설된 국회법 제58조의2의 실효성에 한계가 있음을 확인하 였다. 위헌결정 법률에 대한 국회에서의 후속입법 지연 문제에 대한 개선방안으 로는 현재 위원회의 심사에 대한 강제력이 없는 국회법 제58조의2를 개정하 여 위헌결정 법률에 대한 심사를 의무화하도록 하는 방안과, 현재 후속입법 과정에서 실질적인 역할이 미미한 상태인 국회 내의 후속입법 지원조직을 강화할 필요가 있음을 제시하였다. 주제어 : 위헌결정 법률, 후속입법 기간, 단순위헌결정, 헌법불합치결정, 국회법 제58조의2, 실증연구
Recently, Although the Constitutional Court set a deadline for legislative improvement along with a constitutional inconsistency decision, social confusion has occurred due to the failure of the National Assembly to complete subsequent legislation within that deadline. And in the case of some unconstitutional laws, the legal vacuum continues as subsequent legislation has been delayed for a long time. Accordingly, this paper investigated and analyzed whether subsequent legislation was enacted and the time taken for subsequent legislation for all laws that were decided to be unconstitutional from 1988, when the Constitutional Court was inaugurated under the current Constitution. to the present. Through this, overall and objective current status data on the subsequent legislation for laws that were declared unconstitutional were presented, and problems and improvement measures that can be derived through analysis were discussed. According to the results of the analysis of a total of 805 laws decided to be unconstitutional from 1988 to May 31, 2023, the National Assembly has been carrying out subsequent legislation on all types of unconstitutional laws, including simple unconstitutional decisions and constitutional inconsistencies. But there was a problem that the subsequent legislation was delayed overall, with more than 12% of the subsequent legislation taking more than three years and the compliance rate of laws deemed constitutional inconsistent with a deadline for legislative improvement being only 65.2%. In addition, as a result of analyzing the subsequent legislation period of the previous National Assembly after the 13th National Assembly, it was confirmed that there was a limit to the effectiveness of Article 58-2 of the National Assembly Act, which was newly established in December 2016 to promote rapid subsequent legislation. As a way to improve the issue of delay in subsequent legislation in the National Assembly on the unconstitutional law, it was suggested that Article 58-2 of the National Assembly Act, which does not currently have a compelling force for the committee's review, should be revised to mandate the review of the unconstitutional law, and that it is necessary to strengthen the organization that supports subsequent legislation in the National Assembly, which currently plays a minor role in the subsequent legislation process.
