The employee invention system, the product of both social development and science technology progress, is an important part of the patent system. As an important content in the patent law, its function is to regulate the interests between employers and employees, to arouse the enthusiasm of investment of enterprises in research and development and the invention of employees, which is in turn to increase the competitiveness of the enterprise in market, and then ultimately achieve to enhance the national comprehensive strength. As a very important constituent of patent system, weather the design of the detailed rules and regulations are appropriate will have a vital effect on the incentives of patent system. The right ownership and profit distribution of the employee invention not only relate to the interests of both employers and employees, but also affect the economic development and technology innovation of a country and its society.The core contents of the employee invention system included the established conditions, the rights of ownership, and the compensation system. Among them, the rights of ownership and compensation system, which essentially lie in how to distribute the interests of employers and employees, whether the two sides achieve win-win situation, are particularly crucial. It can not substantially affect the interests of the employer and employee relations that whom the service invention right belongs to, the employer or employees, the key is the realization degree of the interests of both sides under different ownership patterns. Based on these three aspects, in this paper, we analyzed and compared the invention systems in Korea with that in China. First of all, in the first and the second chapters, the research purposes and methods of the invention systems are simply described, and the concept of service invention and legislative theory are introduced.In he third chapter the established condition of employee invention systems of the two countries were compared, we were intented to find out and analyze the similarities and differences.In the fourth and the fifth chapters, the right ownership patterns and compensation methods of employee invention systems in both China and South Korea were compared, respectively. There are a lot of differences in these two aspects. By far, the service invention in South Korea is comparatively perfect, while there are still some defects in China. Through the comparison and analyzation of the systems between the two countries, we tried to come up with some corresponding improvement schemes.Finally, in the sixth chapter, the differences, the present problems and the improving schemes of employee invention systems in both China and South Korea were briefly summarized.
