이 논문은 한국 내 결혼이주여성의 체류제도에 대해 알아보고 특히 그 중에서 가장 문제시되는 한국인 배우자의 신원보증제도를 검토할 것이다. 이를 위해 본 연구는 현행 한국 국적법과 출입국관리법에 규정된 한국인 배우자의 신원보증제도를 분석함으로써 이 제도의 문제점을 제시할 것이다. 그리고 미국의 본인청원제도에 대한 분석을 통해 이 문제를 해결할 수 있는 방법을 찾아볼 것이다.결혼이주여성의 가정폭력의 경우 한국인 배우자의 신원보증제도로 인하여 불평등한 가정관계가 형성되고 불합리한 법제, 그리고 가정폭력에 대한 대응책의 부족한 점이 있으므로, 이것을 근절하기 위해서는 한국인 배우자의 신원보증제도와 관련된 문제에 대해 분석하는 것이 필요하다. 현행 법규 하에서는 합법적 체류가 한국인 배우자의 의사에 전적으로 의존하게 되어 결혼이주여성이 혼인관계가 지속을 위해서는 한국인 남편의 가정폭력 행위가 발생하더라도 침묵을 지킬 수밖에 없다. 만약 한국인 배우자의 신원보증을 받지 않는 못하는 경우 강제출국 대상이 될 수 있다.반면에, 미국에서는 결혼이주여성이 가정폭력을 당한 경우 본인청원제도에 의거하여 영주권을 신청할 수 있고 공적기관이 제공하는 서비스를 통해 자신의 이익을 보호할 수 있다. 따라서 미국에서의 가정폭력범죄에 대응하는 본인청원제도와 한국이 다루고 있는 관련법들을 검토함으로써 결혼이주여성이 한국사회에 적응하여 자립할 수 있는 방안을 제시하고자 한다.
This paper studies the retention system for female marriage immigrants in South Korea, esp. the identity assurance system for South Korean spouses. By analyzing identity assurance system for Korean spouses regulated in existing nationality law together with the exit and entry administration law of the Republic of Korea, the research points out problems of the system and comes up with relevant resolutions based on a contrast with self petition system of America.The cases that female marriage immigrants have suffered from family violence show that existence of identity assurance system for South Korean spouses results in unequal family relationships, unreasonable legal systems and inadequate countermeasures against family violence. Correspondingly, it is necessary to analyze the identity assurance system for Korean spouses to totally eradicate the phenomenon. Under current laws and regulations, legal retention completely depends on the wills of their Korean spouses because they will be deported if their identities are not assured by their Korean husbands. In addition, to maintain their marriage relationships, they have to keep silence even when they have suffered from family violence by their husbands. In contrast, female marriage immigrants in America can apply for the rights of permanent residence through self petition and defend their private benefits with the services provided by public institutions. Hence, through the analysis and research of legal systems against family violent crime in America and present relative laws in Korea, the author has proposed a resolution under which female Korean marriage immigrants are able to adjust to the Korean society and live independently there.
