The main obstacle impeding application of general crimes of personal injury and of manslaughter in environmental cases is the necessity to prove causation. Only someone who actually causes the bodily injury or the death of a particular person can be punished for personal injury or killing. By reason of the priniciple of culpability, rules of causation are stricter in criminal law than in private law: Assumption of causation and joint liability of several persons are absolutely forbidden, except in the case of crimes committed jointly and by intent. The first requirement for criminal liability for a result crime, therefore, is the proof of general causation. The person responsible for emitting a poisonous substance can only be punished for personal injuries - e.g. asthmatic attacks of people living next to the emitting plant - if it is a scientific fact that the emittted substance generally is apt to provoke such attacks. Furthermore, causation must also be proved in the individual case. For example, it must be a fact that the emission in question has reached a particular person and has provoked his injury. The defence that another emission may have caused the attack must be refuted beyond any reasonable doubt; otherwise the defendant must be acquitted. In practise, causation of bodily harm by an interference with the environment can be proved very seldom, therefore damage to the environment can only rarely be punished as a serious crime.Due to those notorious difficulties of proof of causation in environmental crimes, theories and legislatures have tried to solve such difficulties. In Korea, Special Act for Punishment of Environmental Crime included unorthodox and controversial features such as a 'presumption of causation'. However, the prevailing opinion criticized this controversial features and recommended a new theoretical approach and a new technique of legislatures. No causation problems arise with respect to offenses of exposure to abstract danger. The offense suitable to produce certain harmful results (German: Eignungsdelikte, also referred to as "offense of potential endangerment") constitute a relatively new type of offense. A new theoretical approach is to interpret "harm" according to legal interests. This modern theory tends to trivialise the harm, for instance, by requiring only that "the body of water has ceased to be clean water" as an interpretation of the pollution of water. The author comes to conclusion that the stable theoretical construction of causal relation leads to an easing of the proof of causation in environmental crimes. This is ture where the special structure of the environmental criminal law provision consists of abstract danger offense or potential endangerment offense (Eignungsdelikte).
지금까지 고찰한 환경범죄의 인과관계를 간략하게 요약하면서 최종적인 결론을 도출하고자 한다. 중국과 한국의 형법에 공통적으로 적용할 수 있는 보편적 형법학으로서의 인과관계 문제는 일반적 인과관계, 즉 전문분야에서 자연과학적으로 승인된 인과법칙이 존재한다는 것을 전제로 해서 행위와 결과 사이의 규범적 척도에 따라 구체적인 인과관계를 확정하는 단계를 거치는 것이다. 첫 단계의 인과관계의 판단으로서 자연과학적으로 승인된 인과법칙이 존재하지 아니한 경우에도, 일정한 범위에서 통계법칙에 의하여 일반적 인과관계의 존재를 증명할 수 있으므로, 사실적 판단을 철학적 판단에 치우치지 않도록 유의하면서, 합법칙적 조건관계의 유무에 따라 일반적 인과관계를 확정할 수 있다. 특히 환경범죄에 있어서는 어떤 오염원으로부터 어떤 과정을 거쳐 결과가 발생하였는지에 관한 인과법칙 내지 통계법칙 조차 없는 경우가 많기 때문에, 그럴 경우에, 일반적 인과관계 자체를 확정할 수 없더라도, 역학적 방법에 의하여 고도의 개연성이 인정되는 경우에는 일반적 인과관계를 입증할 수 있다고도 할 필요가 있다. 그러나 이러한 단계적 고찰이 아니라 일반적 인과관계이론으로서의 역학적 인과관계론은 타당하지 않다. 다시 말해서 역학적 방법으로 구체적 인과관계까지 인정하려고 하는 소위 역학적 인과관계론은 일반적 인과관계의 입증범위를 벗어난 이론으로서 ‘의심나면 피고인의 이익으로(in dubio pro reo)원칙’에 반한다고 해야 한다.또한 환경범죄에 있어서는 오염물질의 원인성과 결과에 이르는 과정이 아직 완전히 밝혀졌다고 할 수 없으므로, 구체적 인과관계, 즉 규범적 척도에 의한 인과관계의 유무는 택일적?누적적?가정적 인과관계의 사례에 대해서 무리없이 조건관계를 인정할 수 있는 규범적 척도 내지 결과의 합목적적 정의설정에 의하여 확정해야 한다. 한편 합법칙적 조건공식에 따른다 하여도 축적?합계?상호관여작용에 의한 복합적 환경오염의 경우, 오염에 대한 위험성 여부가 정확하게 파악되지 않은 새로운 물질이 상호작용하였거나 개별적인 구체적 상황에 따라 그 효과가 전혀 다르게 나타난 경우에는 얼마든지 구체적 결과에 대한 정의설정을 통해 규범적으로 구체적 인과관계를 확정할 수 있다. 이와 같은 배경과 유사하게 인과관계추정설 내지 위험증대이론, 또는 보다 정밀화된 개관적 귀속설 등에 의하여 인과관계 문제를 극복하려는 시도가 주장되고 있다. 그러나 인과관계추정설은 소송법상의 실체진실발견주의, in dubio pro reo원칙 및 무죄추정법리에 정면으로 배치될 뿐만 아니라 실제로 복합적 환경오염행위에 대해서 추정으로 해결하기도 곤란하므로 그 실효성을 거두기 어렵다. 그리고 위험증대이론은 인과관계 확정을 위한 이론이 아니라 객관적 귀책의 척도에 불과하며, 인과관계 확정에 이를 원용하는 경우에도 in dubio pro reo원칙상 타당성을 인정하기 어렵다. 이와는 달리 인과관계 판단의 기준이 되는 결과의 의미를 보호법익에 대하여 불이익한 변경을 가한 사실이라고 이해하려는 결과정의의 수정론은 복합적 환경오염행위의 경우, 환경재에 대한 유해로운 불이익한 변경을 초래하기만 하면 구체적 인과관계(조건관계)를 인정할 수 있으므로 환경침해범을 처벌하는 데에는 타당성을 인정할 수 있다. 다만 이 이론도 일반적 인과관계가 확정되어 있지 않거나 사람의 건강에 대한 위험발생을 요구하는 범죄유형에는 적용할 수 없다는 한계가 있기는 하다. 환경범죄를 구체적 위험범으로 유형화할 때에도 일반적 인과관계(일반적 侵害適性)나 구체적 인과관계(구체적 위험사항)를 확정하는데 어려움이 따르므로 역시 인과관계에 대하여 실효성면에서 효과적인 규범적 인과관계이론이 필요하다. 인과관계의 이론은 책임원칙의 범주를 벗어날 수 없고, 그 최후의 보루가 되어야 한다. 그러므로 환경범죄의 아주 특수한 경우로서 과학적 입증이나 규범적 판단이 곤란한 경우를 해결하기 위하여는, 인과관계이론으로서는 한계가 있을 수밖에 없고, 그 이론적 한계에 대한 근본적인 해결책은 입법론에 있을 수밖에 없다. 인과관계에 대한 근본적인 해결책으로서의 입법론으로서는, 환경범죄의 인과관계 문제를 어려움 없이 해결하기 위해서는 보호법익의 종류와 그 중요성 및 인과관계 입증의 가능성 등을 고려하여 중대한 환경범죄에 대해서는 추상적 위험범(혹은 Risiko犯) 내지 적성범으로 입법화하고, 그 이외의 범죄는 환경침해범으로 규제하면서 환경오염행위로 사람의 건강침해의 위험성까지 야기시키는 경우에는 오염물질의 결과발생 개연성을 고려하여 환경침해범의 결과적 가중범으로 규정하는 선별적 단계화가 필요하다고 본다. 또한 법률상 추정규정은 단지 입법적 변칙으로서 처벌의 강화를 통한 환경보호에의 인식제고라는 효과 외에는 특별히 그 이론적?현실적 합리성을 인정하기 어렵고, 현실적 운용가능성도 적으므로 이론적 파격을 가져오면서까지 이 규정을 도입할 필요는 없다고 하겠다. 오히려 과학적 수사발전을 저해할 우려마저 있
