This study analyzes the legislative process of the French digital republic law to understand how the Internet public sphere in France becomes an official policy communication channel that intervenes directly in the policy decision process beyond the citizen journalism. Digital Republic Law Legislation process, debated since 2012 and promulgated in 2016 and applied for two years until 2018, will be analysed in the frame of ‘policy communication’ with the systematics methode. In other words, the process is observed in three levels: setting up of a policy agenda (input), law contents making process in which various stakeholders debate (process) and after promulgation process (output). The digital republic law has raised the interest of the citizens as a governmental strategic intention to prepare the future digital society from the beginning of the issue. As a result, this became the unprecedented case of making the bill by active citizens from the early stage to the coordination. The French government has successfully focused on one or two platforms as a policy communication media and has gained a high level of quality interactivity with citizens. We note the participating netizens are relatively socially high-level and participated as a ‘citizen’ not representing organizations nor civic society. To the French government trying to extend this case to the whole domain of politics in the name of 'digital democracy', this research gives new problematics about ‘the representativeness of non-participating citizens’ and the weakening civil society in France.
이 연구는 프랑스 디지털공화국법 입법 과정에 나타난 정책 소통을 분석하여 프랑스에서 인터넷 공론장이 시민 저널리즘이라는 프레임을 넘어 정책 결정 과정에 직접 개입하는 제도적인 소통 창구가 되는 있는 현상을 밝히고, 이것이 가져올 수 있는 시민참여 민주주의의 가능성을 고찰해 보고자 한다. 연구의 분석 대상은 2012년부터 논의가 시작되어 2016년 공포되어 2018년까지 2년 여 간의 적용 과정을 거치고 있는 디지털공화국법이며 이를 정책소통이라는 프레임으로 체계이론적 방법론을 활용하여 평가한다. 즉, 정책 소통 과정을 새로운 법의 필요성 대두라는 환경에 따른 정책 의제 설정(투입), 다양한 이해관계자가 법의 내용에 합의하는 정책 결정 과정(과정), 법의 적용을 집행하고 평가하는 정책 집행 및 조정 과정(산출)으로 나누어 분석한다. 분석 결과 프랑스의 디지털공화국법은 그 이슈화 초기부터 프랑스 정부가 사회 경제적으로 미래 디지털 사회를 준비하기 위해 전략적인 의지로 시민의 관심을 불러일으켰으며, 이로 인해 법률 내용 구성의 협의 과정에 온라인 플랫폼을 통해 시민이 초기 단계부터 조율 단계까지 적극 참여하여 법안을 만든 전례 없는 사례가 되었다. 프랑스 정부는 정책 소통 미디어로 한 두 개의 플랫폼에 집중하고 시민의 의견에 질적으로 높은 수준의 응답을 하여 성공적으로 소통의 양방향성을 획득하였다. 여기에 참여한 시민들은 사회적으로 비교적 높은 계층이었으며 참여자의 대부분은 조직이나 시민단체가 아닌 개인의 자격으로 참여하였다. 이번 사례를 ‘디지털 민주주의’라는 이름으로 정치의 전 영역에 확대 적용하고자 하는 프랑스 정부에게 이러한 결과는 참여하지 않는 시민들의 대표성 문제와 정부와 시민을 연결하던 프랑스의 강한 시민사회의 소멸이라는 새로운 문제를 던진다.
