미국의 디지털자산시장이 급속하게 성장하고 있고. 그에 발맞추어 디지털자산산업도 또한 발전함에 따라 많은 일자리를 창출하고 있어서 미국 경제에 긍정적인 영향을 주고 있다. 미국인의 상당수가 디지털자산에 투자를 하고 소유하고 있으며, 디지털자산의 거래 규모도 확대되고 있는 추세에 있다. 2022년 기준으로 미국인의 13.7%가 암호화폐를 보유하고 있으며 인구로는 대략 4,600만명에 이른다. 그리고 암호화폐를 보유한 미국인의 약 44%는 연간 소득 10만 달러 이상의 부유한 미국인이었고, 암호화폐를 보유한 미국인의 대다수는 18세∼44세 그룹으로 전체 82%를 차지하고 있다. 미국에서 디지털자산은 투자대상이며, 디지털자산에 기초한 대출의 담보물로서 활용이 되고 있다. 따라서 디지털자산은 소비자, 투자자 및 기업의 이익과 밀접한 관련이 있다고 할 수 있다. 이러한 상황을 배경으로 2022년 3월 9일, 미국의 조 바이든 대통령은 “디지털자산의 책임 있는 발전의 보장(Ensuring Responsible Development of Digital Assets)”이라는 행정명령에 서명하였다. 현재 미국의 법제도 아래에서 디지털자산에 대한 규제와 감독은 SEC와 CFTC가 경쟁적으로 수행하고 있지만, 디지털자산의 규제와 감독에 대한 법 규정은 모호하고 불명확하여 해석상 많은 법적 논란을 일으키고 있다. 이러한 디지털자산에 대한 법적 규제의 공백을 메우기 위해서 미국의 연방의회에 다수의 디지털자산규제법안이 발의되었다. 대체로 이들 법안들은 증권성이 있는 디지털자산의 경우에는 SEC가 규제권한을 갖고, 증권성이 없는 디지털자산의 경우에는 CFTC가 규제권한을 갖도록 하는 것을 내용으로 하고 있지만, 입법은 여전히 지연되고 있는 상태에 있다. 은행의 디지털자산 관련 업무에 대해서는 기본적으로 은행의 규제감독기관인 OCC가 유권해석(OCC Interpretive Letter)을 통하여 승인을 하고 있다. OCC의 기본 입장은 연방인가은행이 암호화폐, 분산원장기술 및 스테이블코인 관련 업무를 수행할 수 있는데, 은행은 안전하고 건전한 방법으로 이러한 업무를 수행하기 위한 적절한 통제시스템을 갖추어야 한다는 것이다. 디지털자산 관련 업무에 대해서는 보다 명확한 규제와 감독이 필요하다는 점에서 미국에서 디지털자산 관련 입법이 조속히 이루어져야 한다고 본다. 우리나라의 경우에는 미국의 입법상황을 예의 주시하면서, 그 입법의 내용의 분석을 통해 디지털자산에 관한 규제 법안을 마련하는 것이 보다 바람직하지 않았을까 하는 생각을 하게 된다. 나아가 우리나라의 은행이 가상자산 관련 업무를 수행하기 위해서는 추가적인 입법의 필요성도 있다고 본다.
The digital asset market in the U.S. is growing rapidly. In line with that, the digital asset industry is also creating many jobs as it develops, which has a positive impact on the U.S. economy. A significant number of Americans invest in and own digital assets, and the size of digital assets transactions is also on the rise. As of 2022, 13.7% of Americans owned cryptocurrency, with a population of approximately 46 million. And about 44% of Americans who owned cryptocurrency were wealthy Americans with an annual income of more than $100,000, and the majority of Americans who owned cryptocurrency were under the age of 40, accounting for 82% of the total. In the United States, digital assets are investment targets and are used as collateral for loans based on digital assets. Therefore, it can be said that digital assets are closely related to the interests of consumers, investors, and companies. Against this backdrop, on March 9, 2022, U.S. President Joe Biden signed an executive order called "Ensuring Responsible Development of Digital Assets." Currently, the SEC and CFTC competitively regulate and supervise digital assets under the US legal system, but the regulation and supervision of digital assets are ambiguous and unclear, causing a lot of legal controversy in interpretation. In order to fill the gap in legal regulation on digital assets, a number of digital asset regulation bills have been proposed in the US Congress. In general, these bills require the SEC to have regulatory authority in the case of digital assets that have a character of a security and the CFTC to have regulatory authority in the case of digital assets that do not have a character of a security, but legislation is still delayed. Basically, the bank's digital asset-related business is approved by the OCC through OCC Interactive Letter. The basic position of the OCC is that national banks can perform activities related to cryptocurrency, distributed ledger technology, and stablecoins, and banks must have appropriate control systems to perform these activities in a safe and sound way. Since clearer regulation and supervision are needed for digital asset-related activities, digital asset-related legislation should be made as soon as possible in the United States. In the case of Korea, it would be more desirable to prepare a regulatory bill on digital assets through analysis of the contents of the legislation while closely monitoring the legislative situation in the United States. Furthermore, there is a need for additional legislation for commercial banks of Korea to carry out digital asset-related activities.
