자동차 부품 중에는 원래의 구성부품과(original parts) 동일한 외관이 아니면 사실상 수리복원이 불가능한 면이 있다(이른바 Must-match-parts). 범퍼, 휀더 등 자동차 전체 외관을 구성하는 부분들은 사고나 파손되었을 때 원래의 차체와 일치되도록 부분적으로 교체·수리를 해야 하는 곳들이고 이런 부위에 디자인권이 등록되어 있다더라도 수리목적을 위해서는 권리행사가 제한되어야 한다는 즉, 디자인권을 침해하지 않는다고 하는 법제를 수리조항(Repiar Clause)라고 한다. 복합제품의 구성부분을 수리하기 위한 목적의 디자인 사용에는 권리가 미치지 않는다는 디자인 수리조항(Repair clause)은 그간 EU역내 자유로운 시장경쟁을 촉진하고 지재권법의 적용을 통일화하고자 노력했던 유럽에서 활발하게 논의되어 왔다. 최근에 그간 수리조항 도입에 강하게 반대해왔던 독일과 프랑스가 수리조항을 도입함으로써 EU 27개국 중 이탈리아 등 자동차 중심국을 포함한 11개국이 수리조항을 자국법에 도입했다. 또한, EU 디자인지침(Directive)과 공동체디자인규정(CDR)에 다시 통일적으로 수리조항을 도입하자는 유럽집행위원회의 디자인법 개정제안이 2022년 11월 제출되어 절차 중에 있다. EU의회는 동 제안을 2023년 9월 수정채택했고 디자인지침 제19조에 수리조항을 신설하여 공동체규정에 개정반영하고자 하고 있으므로 결과를 주목해봐야 한다. 한편, 현행 EU CDR(공동체 디자인규정) 수리조항의 적용에 대해 유럽사법재판소 CJEU는 2017년 아카시아 판례를 통해 중요한 적용기준을 제공했는데, 수리조항 적용범위에 대해 “수리조항은 구성부품의 형상이 복합제품의 외관에 의해 항상 정해진 경우에만 적용된다는 것이 아니라 완성품이 시장에 투입되었을 때 원래부터 포함되어 있던 구성부품과 동일한 외관을 갖고 있는 경우에 적용되어야 한다”며 Must-match를 넘어선 수리부품에 대해서까지 확장된 적용이 가능하다고 제시했다. 이는 앞으로 수리조항의 각국 적용 및 EU채택에 상당한 영향을 줄 것이며 어떤 사안이었는지 살펴볼 필요가 있다. 더불어 우리나라에서도 자동차의 수리목적 사용을 위해 부품에 대한 디자인권 보호기간을 제한하자는 디자인법 개정안이 5차례 지속적으로 발의되고 있는데, 그 내용과 경과쟁점을 살펴본다. 국내 디자인보호법 개정안은 보호기간을 3년, 5년 등으로 제한하자는 내용으로 주로 접근하는 반면에 유럽공동체 규정은 수리부품의 경우 디자인 보호대상의 예외로 하자는 점에서 접근방법에 차이점이 있다. 우리는 자동차 부품산업 육성을 위해 디자인보호법 개정법률안에 자동차부품만을 대상으로 수리조항식 기간제한 규정을 두고자 했으나, EU 등 다른 곳에서 수리조항은 ‘자동차’ 뿐만 아닌 스마트폰, 전자제품과 같이 애프터마켓이 형성되고 발달할 수 있는 모든 복합제품에 적용될 수 있다는 점도 유의해 주목해야 한다.
The design repair clause that the right does not extend to the use of design for repairing components of complex products has been actively discussed in Europe, which has tried to promote free market competition in the EU and unify the application of the IPR. Recently, Germany and France, which have strongly opposed the introduction of repair provisions, introduced repair provisions, and 11 of the 27 EU countries, including automobile-oriented countries such as Italy, reflected them in their laws. In addition, the European Commission's proposal to revise the design law was submitted in 2022 and is in the process to introduce a unified repair clause into the EU Design Guidelines (Directive) and Community Design Regulations (CDR), so the results should be noted. On the other hand, the European Court of Justice CJEU provided important application standards for the application of the current EU CDR (Community Design Regulations) repair clause through the 2017 Acacia precedent. It was suggested that the scope of application of the repair clause could be extended to repair parts beyond Must-match. This will have a significant impact on the application of repair provisions to each country and the adoption of the EU in the future, and it is necessary to look at the issues. In addition, in Korea, an amendment to the Design Act is continuously being proposed to limit the period of protection of design rights for parts for the use of automobiles for repair purposes, and the contents and competition are examined. The amendment to the domestic design protection law is mainly approached to limit the protection period to three or five years, while the European Community regulations differ in their approach in that repair parts are subject to design protection. It should also be noted that in the EU, the repair clause can be applied not only to 'automobiles' but also to all complex products that can form and develop aftermarket, such as smartphones and electronics.
