재건축은 노후화되어 불안전하고 불량한 주거환경을 안전하고 쾌적한 주거환경으로 조성하여 주민들의 삶의 질을 높이는데 이바지하고 국민의 행복추구권과 재산권, 주거의 자유 등 헌법상 기본권을 실현시키는 중요한 수단이기도 하다. 하지만 재건축사업은 주택시장의 부침과 정권 교체 등으로 관련 법・제도 등이 규제와 완화를 반복하면서 주택시장과 국민들에게 많은 혼란을 주고 있다.김진수, “재건축 안전진단 기준 개선 연구”, 정책분석평가학회보 제30권 제2호, 한국정책분석평가학회, 2020, 231면. 이에 본 연구는 정부가 고시하는 ‘주택 재건축 안전진단 기준’에 대하여 국회에서 제기되고 있는 입법차원의 제도 개선 노력들을 심층 조사 분석하고, 안전진단 관련 전문가 델파이 등을 통하여 합리적인 제도 개선 방안을 도출하고자 하였다. 이러한 과정을 바탕으로 현행 주택 재건축 안전진단 제도 개선 방안을 제시하고자 한다. 첫째, 안전진단 평가기준의 각 항목구성 및 비율 등을 포함한 안전진단 결정 권한을 광역자치단체장에게 위임해야 한다. 주택의 노후도, 건축물의 안전과 재건축 필요성 등은 각 지역마다 다른 상황에서 국토교통부가 일률적이고 획일적으로 안전진단 기준을 설정함으로써 지역의 특성을 반영하지 못할 뿐만아니라 원활한 재건축사업 추진에 장애요인이 되고 있다는 비판이 있다. 따라서 안전진단 기준 등 결정 권한을 광역 지방자치단체장에 위임할 필요가 있다. 둘째, 현행 도시정비법 제2조제3호 나목에서 ‘내진성능이 확보되지 아니한 건축물 중 중대한 기능적 결함’을 노후불량건축물로 정의하고 있다. 그런데 구조안전성 평가 항목에 내진설계 반영 여부가 누락되어 있다. 구조안전성 평가항목에 내진설계 반영 여부가 포함되어야 한다. 셋째, 지질조건이나 지반상태는 건축물 구조안전성에 매우 중대한 영향을 미침에도 불구하고 구조안정성 평가항목에 지질조건이나 지반상태 등이 누락되어 있다. 이러한 중요한 평가요소의 누락은 안전진단 평가 결과에 타당성과 신뢰도를 저하시키는 요인이 되고 있다.김진수, “재건축 안전진단 기준 개선 연구”, 정책분석평가학회보 제30권 제2호, 한국정책분석평가학회, 2020, 250면. 넷째, 석면건축자재 사용 여부가 안전진단 평가항목에 반영되어야 한다. 세계보건기구가 지정한 1급 발암물질인 ‘석면’은 인체에 흡입될 경우 석면폐증· 폐암· 악성중피종 등 치명적인 질병을 유발한다. 따라서 우리나라에서도 석면안전관리법「석면안전관리법」은 석면을 안전하게 관리함으로써 석면으로 인한 국민의 건강 피해를 예방하고 국민이 건강하고 쾌적한 환경에서 생활할 수 있도록 하는 것을 목적으로 2011.4.28. 법률 제10613호로 제정, 공포되어 시행하고 있다. 등을 제정하여 건축물에 포함되어 있는 석면 노출로 인해 국민건강에 피해없도록 철저히 관리하고 있다. 다섯째, 주택 재건축 안전진단 실시에 따라 발생되는 소정의 비용을 지방자치단체에서 지원할 필요가 있다. 다만, 일각에서는 사유재산을 재건축하는 사업에 지방자치단체 예산 투입이 있어서는 안된다는 의견도 있지만, 재건축사업은 해당 지역 토지등소유자의 주거환경을 개선하는 동시에 도로, 공원, 커뮤니티 시설, 공공 임대주택 등 공공의 이익 창출이 되는 측면도 있고, 특히 공동주택 안전관리 책임이 지방자치단체에도 있으므로 안전진단 ...
Reconstruction contributes to improving the quality of life of residents by creating an aging, unstable and poor residential environment into a safe and pleasant residential environment, and is also an important means of realizing basic constitutional rights such as people's right to pursue happiness, property rights, and housing freedom. However, the reconstruction project is causing a lot of confusion to the housing market and the people as related laws and systems repeatedly regulate and ease due to the ups and downs of the housing market and regime change. Accordingly, this study attempted to investigate and analyze legislative system improvement efforts raised by the National Assembly on the "Safety Diagnosis Standards for Housing Reconstruction" announced by the government and derive reasonable system improvement measures through Delphi, experts related to safety diagnosis. Based on this process, I would like to propose a plan to improve the current housing reconstruction safety diagnosis system. First, the authority to determine safety diagnosis, including the composition and ratio of each item of the safety diagnosis evaluation criteria, should be delegated to the head of the metropolitan government. Critics say that the Ministry of Land, Infrastructure and Transport does not reflect the characteristics of the region and hinders the smooth promotion of reconstruction projects by setting safety diagnosis standards uniformly and uniformly in different situations. Therefore, it is necessary to delegate the authority to decide on safety diagnosis standards to the heads of metropolitan local governments. Second, Article 2, Subparagraph 3 (b) of the current Urban Improvement Act defines "significant functional defects among buildings that have not secured seismic performance" as old-age defective buildings. However, whether or not seismic design is reflected in the structural safety evaluation item is omitted. Structural safety assessment items should include whether seismic design is reflected. Third, although geological conditions and ground conditions have a very significant impact on the structural safety of buildings, geological conditions and ground conditions are omitted from the structural stability evaluation items. The omission of these important evaluation factors is a factor that degrades the validity and reliability of the safety diagnosis evaluation results. Fourth, the use of asbestos building materials should be reflected in the safety diagnosis evaluation items. When inhaled into the human body, asbestos, a first-class carcinogen designated by the World Health Organization, causes fatal diseases such as asbestos lung disease, lung cancer, and malignant mesothelioma. Therefore, in Korea, the Asbestos Safety Management Act has been enacted to thoroughly manage asbestos exposure contained in buildings so that it does not damage public health. Fifth, it is necessary for local governments to support certain costs incurred by conducting safety diagnosis for housing reconstruction. However, some say that local governments should not invest in projects to rebuild private property, but the reconstruction project improves the residential environment of owners, such as local land, while creating public benefits such as roads, parks, community facilities, and public rental housing.
