This paper deals with the new meaning of the Ensuring State Theory receiving attention from German academia of public law. This Ensuring State Theory has been introduced in Korean administrative law on a large scale. Nowadays, the society has been suddenly changing with the development of science and technology making a change to the states roles, and people have questions whether a State can play a key role in overcoming public chanllenges in the information-oriented society. Facing innovative development of technologies and an unavoidable information-oriented society, it is necessary to have serious reconsideration on what kind of role a State has to play. The Ensuring States take count of private-public partnerships to provide structural frameworks to let social autonomy work smoothly and establish appropriate regulation frameworks. That is, a State is required to regulate in flexible and specialized way while respecting social autonomy. and the Self-regaulation is highly recommended for the method. The Self-regulation is considered as an appropriate method od regualtion in this information-oriented society. The Self-regulation has both advantages and disadvantages and the Regulated Self-regulation is analyzed. The Government-regulation and the Self-regulation can be fit together. The Regulated Self-regulation has a legal foundation to secure fairness of the Self-regulation and a supervisory authority in charge of monitoring and cooperation for the Self-regulation. The Ensuring State Theory offers unique way to solove the modern states contradictional situation to seek regulation and autonomy at the same time. By researching for the Ensuring State Theory continuously, I hope we find the best way to overcome the above problems for the future.
