민주화 이후 국회 의사절차의 주요 양상으로 입법교착, 일방적 의사결정, 일괄 합의 처리 등이 대표적이다. 다수당의 일방적 의사결정이 소수당의 반발에 의한 입법교착을 초래했다면, 일괄합의 처리는 입법교착으로 나빠진 국회 여론에 대한 여야정당의 반응이라고 볼 수 있다. 이 중에서 입법교착은 국회 의사절차의 양상 전반을 이해하는 데에 핵심적이다. 민주화 이후 한국 국회의 입법교착은 자주 발생하고, 지속 기간이 길며, 의사결정 이전 기본 의사절차 단계에서 발생하는 경향이 있다. 이 글은 이러한 입법교착 양상을 만성적 입법교착으로 규정하고, 제13-20대 국회 원구성 및 임시국회 개회 지연, 의사일정 중단을 통해 확인할 것이다. 그리고 이 글은 만성적 입법교착의 원인을 국회의 합의제 운영방식에 기인하며, 합의제 운영방식이 공식 제도인 국회법보다 비공식 제도로서 국회운영의 관행에 기초한다는 점을 확인하고자 한다.
Since 1987 democratization, the National Assembly’s process was generally carried out in the form of legislative gridlock, unilateral decision making, or collective agreement. which are interconnected. The majority party’s trying to unilateral decision making leads to gridlock caused by the minority opposition party. And the collective agreements have been mainly a result of bipartisan reaction to the worsened public opinion to legislative gridlock. Therefore, the legislative deadlock can be a key necessary to understand the overall aspect of the proceedings of the National Assembly. The legislative gridlock is chronic in Korea because gridlock occurs frequently and takes a long time to finish, and it can take place at any time in the whole process of the National Assembly. And allowing the veto causing the chronic deadlock comes from the customary practice in legislation since 1988, not from the National Assembly Act.
