높은 활용도와 관련 기술의 발전에 힘입어 무인기(UAS)는 군사 분야, 그중에서도 특히 이를 활용한 표적 살해 임무에서 그 효용성을 입증하고 있다. 그러나 무인기를 활용한 표적 살해는 다양한 부작용이 존재하고 이로 인한 전면적 분쟁으로의 확대까지 예상되는바 분쟁 축소를 위해 국제법적 측면에서 적법한 평시 무인기의 표적 살해 수행 요건에 대한 논의가 필요하다. 현행 국제법 분석 결과 평시 적법한 무인기 표적 살해 수행 요건과 관련하여, 자위권 행사의 세부 요건은 무력공격의 발생, 무력행사의 즉각성, 필요성 및 비례성의 원칙이 있다. 이를 바탕으로 미국의 표적 살해 수행 사례를 분석해 그 적법성을 판단했다. 한편 현재 국제법상 무인기 표적 살해 관련 자위권 행사 요건은 예상적 또는 선제적 자위권 인정 관련 법제도와 현실의 괴리, 필요성 원칙 준수 여부에 관한 자위권 행사 국가의 정보 공개 태만, 테러조직의 테러행위 책임을 소재국에 귀속시켜 소재국의 동의 없이 자위권을 행사할 수 있는지와 관련하여 문제점이 파악된다. 이를 해결하기 위해 공격 대상의 성격에 따른 자위권 개념의 차별적 적용, 자위권 행사국에 필요성 원칙 준수 관련 입증책임 부여, 비국가행위자의 테러행위 책임을 소재국에 귀속시킬 수 있는지에 관한 판단 기준을 제시하면서, 현행 국제법상의 자위권 행사요건 검토를 바탕으로 평시 적법한 무인기 표적 살해 수행 요건을 연구결과로 제시했다.
Unmanned Aircraft System(UAS) is demonstrating its effectiveness in the military field, especially in the targeted killing mission using it due to its versatility and improvement of related technology. However, since the targeted killing using UAS has various side effects and is expected to escalate into all-out dispute, it is necessary to discuss legitimate requirements in performing the targeted killing using UAS during peacetime in terms of international law. According to the analysis of the current international law, the requirements to carry out the legitimate targeted killing using UAS are related to the case of the exercise of self-defense under Article 51 of the UN Charter. Its detailed requirements including the occurrence of armed attacks, its immediateness, necessity and proportionality of armed activities. Based on these requirements, we analyzed the U.S. case of the targeted killing and appreciated its legitimacy. Meanwhile, the current requirements for the exercise of self-defense, which reflects the international law, are identified problematic in terms of the gap between the reality and the international legal system related to the scope of the concept of self-defense, the country's negligence of opening evidence related to the necessity of self-defense, and whether the terrorism can be attributed to the country where the terrorists exist to use the right of self-defense. As a solution, we suggest applying the concept of self-defense differently depending on the feature of the target of self-defense, making the country to accomplish the right of self-defense prove the necessity of self-defense, and appreciating whether the terrorism can be attributed to the state where the terrorists exist as a requirement for legitimate self-defense. Finally, as a result of the study, having reviewed the requirements of the current international law to exercise the right of self-defense, we could present the additional requirements for performing the legitimate targeted killing using UAS in peacetime.
