상표는 상품을 식별시키는 표지이므로 상표로 기능하기 위해서는 그 상표가 표시되어 있는 상품은 하나의 출처에서 유래한다는 소비자의 인식이 존재하여야 하는데, 이를 상표의 식별력이라 한다. 본질적으로 식별력이 없는 기술적 표장(descriptive mark) 등의 경우에는 상표권으로 법적인 보호를 받기 위해서는 일정기간 상표로서 사용하여 소비자에게 그 표장이 하나의 출처로 인식되었음을 증명하여야 하는데, 이러한 경우를 사용에 의한 식별력 취득 또는 2차적 의미(secondary meaning)의 획득이라고 한다. 즉 본질적으로 식별력이 없는 표장이라도 그 본래적 의미(1차적 의미) 이외에시장에서 단일의 상업적 출처로 2차적 의미를 획득하는 경우 상표로서 법적보호가 가능하다. 이러한 기술적 표장 등 본질적으로 식별력이 없는 표장이 상표법으로 보호를 받기 위해서는 사용에 의한 2차적 의미의 증명이 필요한데, 소비자의 인식에 해당하는 식별력이라는 추상적인 개념을 객관적.구체적인 증거로 증명하는 것은 어려운 일이다. 이에 최근에는 상표사건에서 과학적이고 객관적인 증거로 ‘소비자 설문조사’의 활용에 대하여 관심이 높아지고 있는 바, 이 글에서는 상표사건에서 소비자 설문조사 활용 유형과 사용에 의한 식별력 취득에 대한 증명을 중심으로 증명력을 인정받기 위한 설문조사의 요건을 살펴본다. 이를 토대로 하여 우리나라 상표사건에서 소비자 설문조사 활성화의 필요성과 이를 위한 제도적 지원방안에 대한 제안을 하였다. 소비자 설문조사결과가 증명력을 인정받기 위해서는 설문조사의 신뢰성이 보장되어야 하므로 모집단 선정, 표본추출, 질문의 형태, 조사방법, 식별력 인정을 위한 응답률의 범위에 대한 구체적 기준을 정립해 나가야할 것이며, 상표에 대한 심사, 심판, 소송단계에서 심사관, 심판관, 판사의 설문조사 실시에 대한 적극적이 유도로 다양한 설문조사 사례 축적을 통한 판단기준을 구축하여야 할 것이다. 또한, 소비자 설문조사의 객관성 및 신뢰성 담보를 위하여 검증(檢證)이나 감정(鑑定)과 유사한 공적인 절차로 제도적 정착을 검토해 볼 필요도 있다.
In trademark law, proposed marks are categorized along a spectrum of distinctiveness. If a proposed mark is not characterized as inherently distinctive, then to achieve trademark status it must be shown that the mark has acquired distinctiveness in the mind of consumers. This status of acquired distinctiveness is known as secondary meaning. It is a new, supplementary meaning attached to a non-inherently distinctive mark; the public, in turn, uses that word or symbol as a trademark or service mark to identify and distinguish a single commercial source. Proof of secondary meaning is not required for every type of trademark. Marks that are inherently distinctive, such as arbitrary and fanciful marks, or suggestive marks, are provided legal protection immediately upon adoption and use. If the mark is not inherently distinctive, it can be registered or protected as a mark only if it can be proven that it has become distinctiveness There are two means of proving secondary meaning-direct evidence and circumstantial evidence. Direct evidence represents the actual testimony of buyers as to their state of mind. Such direct evidence may be obtained through professionally conducted consumer surveys. They can provide the most persuasive evidence of secondary meaning and when a plaintiff has less than a clear case, survey becomes necessary to prove secondary meaning. In this study, I reviewed the type of consumer surveys in trademark disputes and the requirements for accepting the probative weight of consumer surveys focusing on the acquired distinctiveness, and proposed the necessity of policy for use of consumer surveys in trademark trials and disputes.
