勞動政策是政府干預勞動關系、協調勞資利益的基本手段。在我國經濟體制改革過程中逐漸形成了以建立勞動關系市場化運行机制爲目標的勞動政策體系, 其宗旨是建立以勞資個體協商爲核心的勞動關系運行机制。在此基礎上我國逐步確立了以勞動合同制度爲核心的勞動法體系, 希望將勞動關系的運行風險通過合同机制化解在勞動關系內部, 以減輕政府的負擔。但是勞動合同制度與我國勞動政策目標之間却存在着功能沖突, 使得我國勞動政策的實施 缺乏制度保障。
Labor Policy is the basic instruments for the government regulating labor relations. The labor policy of China has been developed since the economical reformation. The main purpose of it is to establish the market-oriented mechanism to regulating labor relations and make the employment contract law the basis of the labor law system, by which the labor disputes would be resulted within the scope of the employee and the employer, in another word, the government would not intervene the individual labor relations. However, this purpose can’t be fur filed by the employment contract law system.
