Stalking is no longer a private matter arising that occurs in romantic relationship between a men and a women, but a serious crime. This public consensus led to the introduction of the 「Act on the Punishment of Stalking Crimes 」in 2021. Since the law was enforced, the number of reports of stalking crimes has steadily increased since 2021 (14,509), with 24,451 case reported from January to September this year. In addition, the recidivism rate of stalking crimes is 12.8%. As you can see, the police response to stalking crimes is critical because stalking is not just a matter of obsession and access, but can lead to serious crimes such as physical violence, confinement, sexual assault, and murder. Nevertheless, the number of police officers dedicated to stalking crimes is still insufficient, with only one more officer than when it was encated, and even after the Stalking Punishment Act with enhanced victim portetion measures came into effect, there have been a number of retaliatory crimes against stalking victims, further increasing public concern and fear of stalking crimes. As a result, there are obvious limitations in the current stalking laws, and it is necessary to identify tpractical problems in order to improve them. Therefore, this study aims to identify the problems and propose effective responses centered on the police response to stalking. To this end, this study specifically analyzed and reviewed various problems in the police's response to stalking crimes more than two years after the Stalking Punishment Act was enacted, and seeks various ways to improve the deficiencies. The findings of this study can be summarized as follows. First, we comprehensively reviewed the concepts and types of stalking crimes presented in previous studies and redefined the concepts and types of stalking crimes appropriate to the Korean context. Second, we examined the procedures for handling stalking crimes based on the police's stalking response manual, examined the status of stalking crimes since the implementation of the Stalking Punishment Act, and analyzed the first-instance judgments of stalking crime protection cases that occurred in 2022 to examine the main issues related to the police's response to stalking crimes. As a result, we identified four main issues: (1) problems in the reporting process, (2) problems in the initial response process, (3) reviewing the effectiveness of the police's protection measures, and (4) increasing the workload of police officers in charge of stalking crimes. Regarding these major issues, the government first proposed measures to improve awareness through continuous communication when receiving a report, and the necessity of establishing grounds under the Stalking Punishment Act for initial measures of on-site police officers' reporting cases, the authority to arrest and detain police officers, and the basis for the current criminal's arrest and forced entry were specified to secure the effectiveness of initial measures, and suggested improvement measures by expanding the types of temporary measures and extending the period of protection measures. It also suggested the necessity of education conducted by specialized institutions to improve awareness of stalking crimes. Next, to strengthen the effectiveness of the police's stalking crime protection measures, it was suggested that violation of emergency measures be punished as a single stalking crime and that aggravated punishment for violation of temporary measures be imposed. It was also suggested that a mandatory short-term storage system be introduced to improve the effectiveness of temporary measures through public measures. Finally, in order to expand dedicated manpower and prepare cooperation measures, it is necessary to conduct stalking response training for on-site collision police officers, reorganize the position dedicated to stalking, secure budget and staffing for the establishment of a stalking crime unit in frontline police stations, and prepare smooth cooperation measures with related organizations. In addition, to respond to manpower problems and insufficient policing demand, the study suggested expanding the scope of investigation by special judicial police officers, establishing multi-agency cooperation, and protecting stalking victims through civilian-oriented multi-agency cooperation. The study is expected to improve the awareness of police officers in the field who still perceive stalking crimes as a private matter and provide effective alternatives for professional prevention and protection of stalking crimes.
스토킹은 더 이상 남녀 사이의 애정 관계에서 발생하는 사적인 문제가 아닌 심각한 범죄이다. 이러한 국민적 공감이 2021년 「스토킹범죄의 처벌 등에 관한 법률」의 도입을 가져왔다. 스토킹처벌법이 시행된 후 스토킹범죄 신고는 2021년(1만 4,509건)부터 꾸준히 증가하여 올해 1월부터 9월까지의 신고 건수가 2만 4,451건을 기록하였다. 그뿐만 아니라 스토킹범죄의 재범률은 12.8%에 달하는 것으로 나타났다. 이처럼 스토킹은 단순한 집착과 접근으로 끝나지 않고 신체적 폭력은 물론 감금, 성폭력, 살인 등 중대범죄로 이어질 수 있는 위험성을 내포하고 있어서 스토킹범죄에 대한 경찰의 대응이 무엇보다 중요하다. 그런데도 스토킹범죄전담경찰관은 신설 당시보다 1명이 충원되는 미흡한 수준이고, 피해자 보호조치가 강화된 스토킹처벌법이 시행된 이후에도 스토킹 피해자를 향한 보복성 범죄가 연이어 발생하면서 스토킹범죄에 대한 국민들의 우려와 공포는 더욱 커지게 되었다. 결국, 현재 시행되고 있는 스토킹처벌법에는 명백한 한계가 존재하고 있고 이를 개선하기 위해서는 실질적인 문제가 무엇인지 파악할 필요가 있다. 이에 본 연구는 경찰의 스토킹 대응을 중심으로 문제점을 파악하고 실효성 있는 대응방안을 제안하고자 하였다. 이를 위해서 본 연구는 스토킹처벌법이 시행된 지 2년여가 지난 시점에서 경찰의 스토킹범죄 대응 상에 다양한 문제점을 구체적으로 분석 및 검토하고, 이에 대한 미비점을 개선하기 위한 다각적인 방안을 모색하고자 하였다. 본 연구의 결과를 요약하면 다음과 같다. 우선 선행연구에서 제시한 스토킹범죄의 개념과 유형을 종합적으로 검토하여 국내 실정에 적합한 스토킹범죄의 개념과 유형을 재정립하였다. 둘째, 경찰의 스토킹 대응 매뉴얼을 바탕으로 스토킹범죄의 처리 절차를 검토하였고, 스토킹처벌법 시행이후의 스토킹범죄 현황을 살펴보고, 2022년 동안 발생한 스토킹범죄 보호조치 불이행 사건의 1심판결 분석을 통해 경찰의 스토킹범죄 대응관련 주요 쟁점을 살펴보았다. 쟁점으로는 ① 신고접수 과정에서의 문제점, ② 초동조치 과정에서의 문제점, ③ 경찰의 보호조치 실효성 검토, ④ 스토킹범죄전담경찰관의 업무 가중 총 4가지로 쟁점을 파악하였다. 이러한 주요 쟁점과 관련하여 우선 신고접수 시 지속적인 의사소통 과정을 통해 인식의 개선방안을 제안하였고, 현장 출동 경찰관의 신고사건에 대한 초동조치에 있어 근거를 스토킹처벌법에 둘 필요성과 출동 경찰관의 체포와 구속을 할 수 있는 권한과 현행범체포와 강제출입을 가능하도록 근거를 명시하여 초동조치에 실효성을 확보할 필요성과 잠정조치의 종류 확대 및 보호조치 기간의 연장을 통한 개선방안을 제시하였다. 또한 스토킹범죄 인식 개선을 위해 전문기관에서 진행하는 교육의 필요성을 제시하였다. 다음으로 경찰의 스토킹범죄 보호조치 실효성 강화에 있어서는 긴급응급조치 위반의 경우 하나의 스토킹범죄에 준하여 처벌할 필요성과 잠정조치 위반의 경우에도 가중처벌의 필요성을 제시하였다. 또한 잠정조치의 개선을 위하여 의무적 단기유치 제도를 도입하여 공적인 조치를 통한 개선책을 제시하였다. 마지막으로 전담인력의 확충 및 협력방안 조성에 대한 대응방안으로는 현장충돌 경찰관을 대상으로도 스토킹 대응 교육을 실시하고, 스토킹 전문 직제를 새롭게 개편, 일선 경찰서 내에서 스토킹범죄 전담 부서설치를 위한 예산 확보와 인력의 뒷받침, 관련기관과의 원활한 협조 방안 등이 마련되어야 할 것으로 판단된다. 또한 인력문제와 치안수요의 부족함을 충족시키기 위해 특별사법경찰관의 수사범위 확대와 다기관 협력방안 조성 및 민간중심의 다기관과의 협업을 통하여 스토킹피해자 보호방안을 제시했다. 이 연구를 통하여 스토킹범죄를 여전히 사적인 문제로 인식하는 현장 경찰의 인식개선과 이를 통해 스토킹범죄의 전문적인 예방과 보호가 이루어질 수 있도록 실효성 있는 대안이 될 것으로 기대한다.
