본 논문은 미국의 인사청문회제도의 시사점을 살펴보고, 이를 바탕으로 우리나라 국회 인사청문회 실시 사례분석, 쟁점별 유형 분석 및 「인사청문회법」 발의법안 사례분석을 통해 우리나라 인사청문회제도의 문제점과 개선방안을 제시하였다. 제2장에서는 우리나라 인사청문회제도의 도입 배경, 관련 법적 근거 및 청문절차 등 현황에 대해 알아보았고, 현재 운영 과정에서 발생하고 있는 문제점과 인사청문회의 필요성을 고찰하였다. 한편, 건국이후부터 인사청문회제도를 운영하고 있는 미국 인사청문회의 기원, 법적근거, 대상범위, 절차를 살펴보았고, 주요 사례를 들어 미국과 한국의 인사청문회제도를 비교하여 이에 따른 시사점을 도출하였으며, 제3장의 인사청문회 운영 분석을 위해 기존 선행연구 검토와 인사청문회 운영 분석방법을 기술하였다. 제3장에서는 정부별 공직후보자 인사청문 실시 사례분석을 통해 우리나라에서 실시되고 있는 인사청문회의 특징을 살펴보았고, 이 중 행정부 공직후보자를 중심으로 쟁점별 사례분석을 통해 문제점을 도출하는 한편, 「인사청문회법」 발의법안 사례를 분석하였다. 먼저 정부별 공직후보자 인사청문 실시 사례분석을 통해, 최근에 국회에서 통과하지 못한 공직후보자가 증가하는 것을 알 수 있었고, 쟁점별 사례분석을 통해 우리나라의 인사청문회는 도덕성 검증 위주로 운영되는 것을 확인하였다. 또한 명확한 도덕성 검증기준이 부재하고, 선거나 당론 등의 정치적 환경이 인사청문회 결과에 많은 영향을 끼치는 것을 알 수 있었다. 다음, 「인사청문회법」 발의법안 사례를 분석을 통해서는 여당 의원보다는 야당 의원이 인사청문회제도 개선을 위해 적극적으로 법안을 발의한 것을 알 수 있었다. 이것은 여야 소속별로 정치적 이해관계에 따라 법안 발의에 영향을 주는 것으로, 여당의 입장에서는 정치적 전략에 따라 대통령의 인사권을 최대한 보호하고 존중하려는 반면, 야당의 입장에서는 대통령의 인사권을 견제하기 위하여 인사청문회의 국회 기능 및 권한을 강화하려는 것으로 해석되었다. 제4장에서는 도출된 문제점을 개선하기 위한 방안으로, ⅰ) 인사청문 결과에 대한 임명권자의 구속 여부 검토 필요, ⅱ) 행정부의 사전 검증체계 구축, ⅲ) 인사청문회 심사단계의 이원화, ⅳ) 인사청문회 검증기준 마련 필요, ⅴ) 인사청문 기간의 연장, ⅵ) 자료제출 관련 법률 정비 필요, ⅴ) 의원의 자율성 강화, ⅵ) 인사청문회제도 개선을 위한 입법화 필요 등을 제시하였다. 제5장에서는 우리나라 인사청문회에 대한 분석을 통해 도출된 문제점 및 개선방안을 간략하게 기술하였다.
This paper examines the implications of the United States' personnel hearing system and, based on this, identifies problems and ways to improve Korea's personnel hearing system through cases of personnel hearings conducted by the Korean National Assembly, analysis of types of issues, and case studies of the 「Personnel Hearing Act」 presented. In Chapter 2, we looked into the background of the introduction of Korea's personnel hearing system, the related legal basis, and the current status of the hearing procedure, and considered the problems occurring in the current operation process and the need for personnel hearings. Meanwhile, the origin, legal basis, scope, and procedures of personnel hearings in the United States, which has been operating a personnel hearing system since the founding of the country, were examined, and implications were drawn by comparing the personnel hearing systems of the United States and Korea, citing major cases. In order to analyze personnel hearing operations in Chapter 3, existing prior research and analysis methods for personnel hearing operations were described. In Chapter 3, we looked at the characteristics of personnel hearings being conducted in Korea through an analysis of cases of personnel hearings for public office candidates by government. Among these, problems were derived through case analysis for each issue focusing on candidates for public office in the executive branch, and Case studies on bills proposed under the “Hearing Act” were analyzed. First, through an analysis of cases of personnel hearings for public office candidates by government, it was found that the number of public office candidates who failed to pass the National Assembly has recently increased, and through an analysis of cases by issue, it was confirmed that Korea's personnel hearings are focused on verification of morality. In addition, it was found that there was no clear morality verification standard and that the results of personnel hearings were greatly influenced by the political environment such as elections and party opinions. Next, through analyzing cases of bills proposed under the Personnel Hearing Act, it was found that opposition party lawmakers more actively proposed bills to improve the personnel hearing system than ruling party lawmakers. This affects the proposal of bills according to the political interests of each ruling and opposition party. From the opposition party's perspective, it seeks to protect and respect the President's personnel rights as much as possible according to its political strategy, while from the opposition party's perspective, it holds personnel hearings in order to keep the President's personnel rights in check. It was interpreted as an attempt to strengthen the functions and authority of the National Assembly. In Chapter 4, measures to improve the identified problems include ⅰ) the need to review whether the appointing authority should be detained for the results of the personnel hearing, ⅱ) establishment of a prior verification system by the administration, ⅲ) dualization of the personnel hearing screening stage, and ⅳ) personnel hearings. It suggested the need to establish verification standards, v) extension of the personnel hearing period, vi) the need to revise laws related to data submission, v) strengthening the autonomy of lawmakers, and vi) the need for legislation to improve the personnel hearing system. Chapter 5 briefly describes the problems and improvement measures derived from the analysis of Korea's personnel hearings.
