지구촌의 기후변화는 이미 세계에서 가장 중요한 환경문제 중 하나로, 이러한 인위적 온실가스 배출을 줄여 온난화의 피해를 막기 위한 노력의 일환으로 국제정치와 국제법에서 유엔기후변화협약과 파리협약은 세계적인 규범으로 자리 잡았고, 녹색·친환경·저탄소·감축은 각국의 정치·경제·외교·무역·안보정책 등의 영역으로 자리 잡았다. WTO규범은 현재의 국제경제 무역질서를 만들어내는 주체로, 글로벌 경제 운용의 중요한 제도이자 법의 틀이다. 따라서 저탄소 경제 연구는 WTO규범과 긴밀히 결합해야 한다. 보조금지급 및 탄소국경세 등 각국의 기후변화 경감 활동 혹은 조치는 세계무역질서를 다루는 WTO의 각종 협정들과 불가분의 관계를 가진다. 법률 및 사법적 측면에서 이러한 조치의 운용 체제를 총결산하고, WTO규범에서 어떻게 작동하며, 그 정당성을 어떻게 발전시킬 것인지를 분석하고 전망한다.저탄소경제의 전반적 목적이 온실가스 농도를 안전한 수준에서 안정화시키고 신재생에너지 정책, 기술 혁신을 하는 것이라면, WTO의 목적은 자유무역의 확대에 있으며 이를 위하여 자유무역에 역행하는 각종 장벽을 낮추거나 없애는 것이 주요 관심사이다. 저탄소경제와 WTO규범은 온실 가스 감축을 통한 지구온난화를 방지하는 환경보호 목적과 자유무역이라는 경제적 목적이 인간의 삶의 질 향상에 있는 이상 서로 상충되는 것이 아니고 상호 보완 및 협력의 관계에 있다고 할 수 있다. 본 논문의 제2장에서는 기후변화협약의 배경 및 경과를 중국의 저탄소경제 정책 중심으로 주요 내용을 검토한다. 중국이 저탄소 경제를 실현하기 위해 추진 중인 주요 정책수단들인 탄소중립 선언, 탄소세, 배출권거래제, 탄소국경조정세, 보조금, 탄소라벨링 등의 도입배경과 주요 내용을 검토한다. 제3장에서는 신기후체체하의 국제규제와 GATT/WTO체제하의 무역과 환경의 연계를 위한 노력을 중국 저탄소경제 현황 및 향후 추진 계획까지 전반적으로 살펴보고, 기후변화협정과 WTO규범간의 상충성을 검토한다. 본 장에서는 탄소국경세, PPMs, GATT 제20조 등에 상관관계를 살펴본다. 더불어 GATT/WTO체제하에서의 다뤄진 환경 관련 분쟁사례도 분석하고 있다.제4장에서는 중국 저탄소경제 정책들과 WTO규범간의 조화 방안에 대해 논의한다. 탄소국경세 도입 가능성을 포함하여, 환경보호를 목적으로 하는 다자간환경협정과 자유무역의 확대를 목적으로 하는 WTO규범 간의 조화를 위한 미래 대응 방안에 대해 면밀히 살펴본다. 마지막으로 결론 부분에서는 탄소국경세 도입과 관련하여 중국 정부가 운영 단계에서부터 개입하여, WTO규범과의 상충가능성을 최소화하고 해결방안을 모색할 것을 제안하고 있다. 한편, 저탄소경제 체제를 원활히 구현하기 위해서는, 타 국가들과 보다 긴밀한 상호 협력 체제를 구축하기를 제안한다. 이러한 다자간 협력 플랫폼 구축을 통하여 이해당사국들 간 원활한 온실가스 감축 목표를 설정하고 실행하게 되면, 지구온난화 개선이라는 전 지구적 공동목표와 환경 보호, 그리고 자유무역의 확대라는 경제적 목적을 동시에 달성하는 것이 가능할 것이다.
Since the Industrial Revolution of the 18th century, it has been estimated that 90% of global warming due to the use of fossil fuels is the result of human use. Consequently, global climate change has become the most important environmental issues in the world especially the impact of greenhouse gases. In an effort to reduce anthropogenic greenhouse gas emissions, the U.N. Climate Change Convention and the Paris Convention have become global norms for dealing with greenhouse gas emissions and encouraging low-carbon solutions. The WTO, an important system and legal framework for global economic management that creates the current international economic and trade order, can establish global carbon emission regulations. Therefore, low-carbon economic research must be closely coupled with WTO rules. Climate change mitigation activities or measures, such as subsidies and border tax adjustments, are in extricably related to various WTO agreements dealing with the world trade order and carbon emissions. In legal and judicial terms, we aggregate the operating mechanisms of these measures, analyze and forecast how green policies operate in WTO rules, and how to develop the legitimacy of these policies.This paper analyses how the overall purpose of the low-carbon economy to stabilize greenhouse gas concentrations at a safe level and to innovate new energy policies and technologies, in which the WTO's purpose is to expand free trade by lowering or eliminating barriers that impact free trade, is major concern when establishing policy and regulation. The Low-carbon economy and WTO regulations are not conflicting but complementary and cooperative as long as the environmental protection and free trade aims to prevent global warming through greenhouse gas reduction improve the human quality of life. Chapter 2 examines the background, progress, and key details of the climate change agreement. It reviews the background of the introduction of policy measures to realize a low-carbon economy, such as border tax adjustment, emissions trading, subsidies, and carbon labeling.Chapter 3 looks at efforts to link GATT/WTO trade with the environment and examines the conflict between climate change agreements and WTO norms. It looks at the relationship WTO agreements such as border tax adjustment, PPM, and GATT XX clause have with environmental policy. In addition, we look at environmental dispute cases under the GATT/WTO regime.Chapter 4 examines the problems, dispute cases and countermeasures of multilateral environmental agreements aimed at protecting the environment, including carbon border tax adjustments, and WTO agreements aimed at expanding free trade. By reviewing the possibility of conflicts in the WTO agreement and working together to find a solution during the carbon border adjustment phase, both the environmental protection objective of preventing global warming through greenhouse gas reduction and the economic goal of expanding free trade is achievable and sustainable.
