The interpretative basis for improving the poor treatment of irregular workers is mainly found in the correction of discrimination. However, poor treatment also means that a fair share of labor itself is not given, and the solution can be found in the constitutional adequate wage guarantee obligation(“AWGO”). The AWGO were first established in the 1980 Constitutional amendment. This is based on the fact that until 1980, the government's policy of growth-firstism had widened the gap between the rich and the poor due to insufficient distribution of its fruit and the minimum wage system had not being implemented for more than 25 years. For this background, the academic community has interpreted the adequacy of wages as a human standard of living. This can be seen as an abstract standard that is universally applied to all labor providers. However, over time, the social security system was expanded, the minimum wage system was implemented, and voices calling for respect for labor were raised. In this regard, there is a need to reconsider conventional interpretation. In particular, respect for labor involves the payment of a adequate wage for labor, which is related to the human dignity. Therefore, today's adequate wage should also be seen as a justifiable price for individual concrete work. In other words, individual and specific standards should be presented in addition to the abstract standards of wage adequacy. The AWGO is literally based on effort on the degree of performance of the obligations, and thus have little effect on judicial review. Even so, neither the assembly nor the government can disregard its meaning. To identify the adequate wage from an individual and concrete perspective can be attempted by checking the wage status by occupation and job and accumulating data. The assembly and the government should actively take the lead in finding the adequate wage.
실무에서는 비정규직의 열악한 처우를 개선하기 위한 해석론적 근거를 주로 차별시정에서 찾고 있다. 차별시정은 비교대상을 선정하는 것이 필수적인바, 적절한 비교대상을 찾지 못하면 성립되기 어렵다. 그러나 열악한 처우는 노동 자체에 대한 정당한 몫이 주어지지 않았다는 점을 의미하기도 하므로, 문제가 되는 직무에 대한 정당한 몫이 무엇인가를 산정하는 방식에 의해서도 해결이 가능하다. 이러한 방식은 헌법 제32조 제1항에서 규정하고 있는 적정임금보장의무에서 그 법적 근거를 찾을 수 있다. 적정임금보장의무는 1980년 헌법에 처음 규정되었다. 1980년에 이르기까지 정부의 성장우선주의 정책으로 인해 성장 과실에 대한 분배가 적정하게 이루어지지 않아 빈부격차가 심화된데다 최저임금제가 20년 넘게 시행되지 않고 있다는 점이 도입의 배경이 되었다. 이러한 배경으로 인해 학계는 오랫동안 임금의 적정성에 대해 인간다운 생활 수준으로 해석함으로써 모든 노무제공자에 보편적으로 적용되는 추상적 기준을 제시해 왔다. 그러나 시간의 경과로 사회보장제도가 확충되고 최저임금제가 시행되었으며 노동존중을 요구하는 목소리가 높아짐에 따라 이러한 해석론을 재검토할 필요가 생겼다. 특히 노동에 대한 존중은 노동에 대한 정당한 대가의 지급을 포함하고 있으며 이는 곧 인간 존엄성의 옹호와도 관련성이 크다. 이러한 관점에서 이제 적정임금은 전통적 견해에 더하여, 개별‧구체적 노동에 대한 정당한 대가도 의미한다고 볼 필요가 있다. 즉, 임금의 적정성에 대한 추상적 기준 제시에서 더 나아가 개별적, 구체적 기준을 제시하여야 한다. 적정임금보장의무는 의무이행의 정도에 대해 노력을 기준으로 삼고 있어 사법심사에서는 큰 효력을 갖지는 못하지만, 그렇다하여 입법부와 행정부가 그 의미를 폄하할 수 있는 것은 아니다. 이에 입법부와 행정부가 적정임금 발견에 적극적으로 나설 필요가 있다. 정당한 대가를 의미하는 적정임금을 개별, 구체적 관점에서 확인하기 위해서는 직종별, 직무별 임금 현황을 파악하고 그에 관한 자료를 축적하는 방식을 고려해 볼 수 있다.
