우리나라의 공무원 및 「공직자윤리법」상의 공직자는 행위 및 신분에 따라 행동강령의 통제를 받고 있는데 그 주요한 통제의 내용은 금지 또는 제한이다. 이 중 갑질 금지(직무권한 등을 행사한 부당 행위의 금지) 조항은 공무원(공직자)이 직무권한을 행사하거나 지위・직책 등에서 유래되는 사실상의 영향력을 행사하여 부당한 행위를 해서는 안 된다고 규정하고 있다. 아울러 근로자의 근로조건을 규정한 「근로기준법」은 직장 내 괴롭힘 금지 제도를 가지고 있다. 여기서는 사용자 또는 근로자는 직장에서의 지위 또는 관계 등의 우위를 이용하여 업무상 적정범위를 넘어 다른 근로자에게 신체적・정신적 고통을 주거나 근무환경을 악화시키는 행위를 금지하고 있다. 이 때, 양자 모두 직무권한 또는 업무상 적정범위를 초월하였는지 여부가 갑질행위 또는 직장 내 괴롭힘 행위인지를 판단할 수 있는 주요한 쟁점이자 판단기준인 바 이를 통해서 양자의 규정상의 목적이 동일함을 미루어 알 수 있다. 즉 위 두 금지조항을 통하여 통제하고자 하는 행위의 본질은 직무의 부당한 남용을 방지하고자 하는데 있으므로 이를 일원화(一元化)하여 하나의 입법으로 통제의 대상이자 적용대상인 공직자에게 보다 명확한 실무적 통제방안을 제언코자 한다.
Public servants in Korea and public officials under the Public Officials Ethics Act are subject to a code of conduct based on their behavior and status, and the main content of the code is prohibition and restriction of public officials. Among them, the prohibition of abuses (prohibition of unfair acts by exercising job authority) stipulates that public officials(or public servants) must not engage in unfair acts by exercising their job authority or exercising de facto influence derived from their status or position. In addition, the Labor Standards Act, which regulates the working conditions of workers, has a system for prohibiting workplace harassment. It prohibits an employer or worker from using their position or relationship at work to cause physical or mental pain to another worker or to worsen the working environment beyond the reasonable scope of their duties. In both cases, the main issue and judgment criteria for determining whether it is an act of abusive behavior or workplace harassment is whether it exceeds the authority of the job or the appropriate scope of the job. In other words, the essence of the acts to be controlled through the above two prohibitions is to prevent unreasonable abuse of duties, so we will propose a clearer practical control method for public officials who are the object and subject of control by unifying them.
