As interest in sports increases, disputes between various members, including not only players and coaches, but also group executives, are increasing day by day. Since there is more to lose than gain when resolving sports disputes using general dispute resolution methods, it is important to understand the special characteristics of sports disputes and prepare a solution appropriate for them. Examples of sports disputes include objections to group decisions regarding athlete qualifications and rights, non-compliance with the terms of sponsorship contracts, infringement of intellectual property rights or content usage rights, unfairness or excessiveness of doping sanctions, and misjudgments by match referees. In order to properly resolve sports disputes, major issues such as maintaining sports autonomy, securing expertise and speed for dispute resolution, and improving the imbalanced status of the parties must be taken into consideration in a complex manner. Sports organizations have established regulations for resolving sports disputes and ensure that they can undergo internal mediation or arbitration, as well as mediation or arbitration by the Korea Sports Council, and ultimately undergo a reconsideration procedure through CAS. In addition, speed and fairness are the most important factors in resolving sports disputes. The establishment and operation of an arbitration organization to resolve sports disputes must take these factors into account. In particular, independence is something that must be resolved preemptively for a fair resolution of sports disputes. The reason is that CAS has gained its status by being reborn as an independent organization from the IOC. In the sports field in Korea, the establishment of an independent sports dispute resolution organization is necessary to ensure speed, professionalism, and fairness in dispute resolution. To achieve this, it is necessary to secure arbitrators with expertise and to understand and promote the arbitration system. We hope that the foundation for wise response to sports disputes will be laid through continued discussions on the establishment and operation of an arbitration organization to resolve sports disputes.
