We carried out a qualitative study, with psychoanalytic orientation, so that we were able to go deeper into the investigation of the emotional impact that the undoing of the marital bond through judicial litigation causes. Ten adults participated in the research, on a voluntary basis, 4 men and 6 women, whose ages ranged from thirty-five to seventy-five years old, who have gone through a litigious judicial process in the past, and who have common children with ex -partners, minors at the time of the judicial process. Open interviews were conducted individually based on the guiding question "How was your personal experience during the divorce litigation?" in order to provide participants with the possibility to talk about their experiences through the free association of ideas and affections. After each interview, a Transferential Narrative (TN) was elaborated, which configures a first level of analysis of the narrative material, taking into account the context and content of the meetings, as well as the researcher's personal impressions. The set of TNs taken as a collective production was shared with the research group for the second stage of analysis which resulted in the interpretation of the affective-emotional meanings ?Unhappy forever after?, which denotes the longevity of the emotional repercussion of the divorce, and its two subfields: ?The fault lies with the other?, which alludes to the spouses' inability to take responsibility for the reality they have experienced; ?What about the children??, which reflects the condition of the minors involved in the divorce process, whose needs are neglected due to the parental emotional condition of the parents. Our findings suggest that the litigious judicial process, as it is conducted today, ends up potentiating the suffering of the individuals involved, whether they are part of the process or common children, which demands the creation of alternatives in order to prevent and / or mitigate the harmful effects of litigious divorce. Considerando que o n?mero de processos litigiosos decorrente da fal?ncia da uni?o afetiva entre c?njuges vem apresentando aumento significativo nos ?ltimos anos, objetivamos nesta pesquisa compreender como essa experi?ncia ? emocionalmente processada e integrada ? hist?ria de vida de cada um. Realizamos um estudo qualitativo, de orienta??o psicanal?tica, de modo que pudemos nos aprofundar na investiga??o do impacto emocional que o desfazimento do v?nculo conjugal por meio do lit?gio judicial provoca. Participaram da pesquisa, em car?ter volunt?rio, 10 adultos, sendo 4 homens e 6 mulheres, cuja idade variou de trinta e cinco a setenta e cinco anos, que passaram por um processo judicial litigioso, no passado, e que t?m filhos comuns com os ex-parceiros, menores de idade ? ?poca do processo judicial. Entrevistas abertas foram realizadas individualmente a partir da pergunta norteadora ?Como foi a sua experi?ncia pessoal durante o processo judicial litigioso de div?rcio?? com o intuito de proporcionar aos participantes a possibilidade de discorrer acerca de suas viv?ncias por meio da associa??o livre de ideias e afetos. Ap?s cada entrevista foi elaborada uma Narrativa Transferencial (NT), a qual configura um primeiro n?vel de an?lise do material narrativo, levando em conta o contexto e o conte?do dos encontros, assim como as impress?es pessoais da pesquisadora. O conjunto das NTs tomadas como produ??o coletiva foi compartilhado com o grupo de pesquisa para a segunda etapa de an?lise a qual resultou na interpreta??o do campo de sentidos afetivo-emocionais ?Infelizes para sempre?, que denota a longevidade da repercuss?o emocional do div?rcio, e seus dois subcampos: ?A culpa ? do outro?, que faz alus?o ? impossibilidade dos c?njuges de assumir a responsabilidade pela realidade vivida; ?E os filhos??, que reflete a condi??o dos menores envolvidos no processo de div?rcio, que t?m suas necessidades negligenciadas em raz?o da parca condi??o emocional dos pais. Nossos achados sugerem que o processo judicial litigioso, do modo como ? conduzido hoje, acaba por potencializar o sofrimento dos indiv?duos envolvidos, sejam eles parte do processo ou filhos comuns, o que demanda a cria??o de alternativas de modo a prevenir e/ou atenuar os efeitos nocivos do div?rcio litigioso.
