The article offers updates on attorney fee statutes in governmental entity cases in Idaho. Common attorney fee statutes that apply in lawsuits against governmental entities are Idaho Code Sections 12-117, 12-121 and 6-918A. Section 6-918A applies to tort act claims bought against a government entity and award of attorney fees is discretionary. Section 12-117 applies to any case involving agency/subdivision and a person and award of attorney fees is mandatory.
